【摘要】：世界各國(guó)均因老齡社會(huì)的到來(lái)而啟動(dòng)成年監(jiān)護(hù)的立法活動(dòng),《民法總則》通過(guò)修改《民法通則》上的監(jiān)護(hù)制度而構(gòu)建了我國(guó)的成年監(jiān)護(hù)制度。成年監(jiān)護(hù)制度可分為成年法定監(jiān)護(hù)與成年意定監(jiān)護(hù)兩種類型,后者被監(jiān)護(hù)人意思自治程度要高于前者。成年監(jiān)護(hù)制度能夠?qū)夏耆巳松碡?cái)產(chǎn)權(quán)益進(jìn)行妥當(dāng)管理及保護(hù),在老齡化社會(huì)中具有重要作用。成年監(jiān)護(hù)制度在主體范圍、事務(wù)范圍、公權(quán)力的介入與保障等方面比委托和信托更具優(yōu)勢(shì)。
[Abstract]:All countries in the world have started the legislation of adult guardianship because of the coming of the aging society. The "General principles of Civil Law" has constructed the adult guardianship system of our country by modifying the guardianship system on the "General principles of Civil Law". Adult guardianship system can be divided into two types: adult statutory guardianship and adult consensual guardianship, and the latter is more autonomous than the former. Adult guardianship system can properly manage and protect the personal and property rights and interests of the elderly, and plays an important role in the aging society. The adult guardianship system has more advantages than entrustment and trust in the scope of subject, scope of affairs, intervention and protection of public power.
