【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的發(fā)展,數(shù)字作品已經(jīng)成為人們文化生活的重要消費(fèi)品,數(shù)字作品的版權(quán)保護(hù)越來越重要。近年來,我國對著作權(quán)法體系進(jìn)行了全面修訂,完善了著作權(quán)的法律內(nèi)容,從立法層面上解決了網(wǎng)絡(luò)著作權(quán)的保護(hù)問題。 數(shù)字作品的廣泛傳播和數(shù)量的快速增長使得版權(quán)保護(hù)工作面臨嚴(yán)峻的挑戰(zhàn),主要集中在如何對權(quán)利的主體進(jìn)行認(rèn)定和侵權(quán)證據(jù)效力不確定兩個問題上。權(quán)利的主體是指權(quán)利人擁有某作品的權(quán)利范圍以及可以擁有該權(quán)利范圍的時間期限、使用該權(quán)利的地域范圍。侵權(quán)證據(jù)效力是指能夠證明侵權(quán)行為、維護(hù)權(quán)利人合法權(quán)利證據(jù)的有效性。 本文針對數(shù)字作品經(jīng)多級授權(quán)后,無法確定授權(quán)人是否有權(quán)利將該權(quán)利授予被授權(quán)人、被授權(quán)的權(quán)利是否已經(jīng)被專有授權(quán)給其他權(quán)利人,無法有效證明授權(quán)的合法性等問題。研究了數(shù)字作品基本授權(quán)信息的類型,包括權(quán)利種類、授權(quán)的時間范圍、授權(quán)地域范圍和許可方/被許可方的基本信息。分析了數(shù)字作品權(quán)利轉(zhuǎn)移的邏輯關(guān)系,通過抽象權(quán)利鏈基本模型、組合形態(tài)模型,建立集合符號體系,設(shè)計(jì)構(gòu)建算法,解決了合法授權(quán)認(rèn)定和證據(jù)效力證明的問題。其中的關(guān)鍵研究內(nèi)容是,結(jié)合模型、符號體系和構(gòu)建算法,完成了對數(shù)字作品權(quán)利鏈構(gòu)建方法的研究。并根據(jù)版權(quán)保護(hù)實(shí)際工作,應(yīng)用上述核心構(gòu)建方法,設(shè)計(jì)并實(shí)現(xiàn)了數(shù)字作品版權(quán)保護(hù)權(quán)利鏈構(gòu)建系統(tǒng)。完成了數(shù)字作品權(quán)利鏈構(gòu)建方法在實(shí)際應(yīng)用過程中的檢驗(yàn)。 本文的創(chuàng)新點(diǎn)是抽象出了構(gòu)建權(quán)利鏈的兩類七種模型,一套構(gòu)建權(quán)利鏈的符號描述體系和四種構(gòu)建算法。
[Abstract]:With the development of Internet technology, digital works have become an important consumer goods in people's cultural life, and the copyright protection of digital works is becoming more and more important. In recent years, the system of copyright law has been comprehensively revised, the legal content of copyright has been perfected, and the protection of network copyright has been solved from the legislative level. With the wide dissemination of digital works and the rapid growth of the number, copyright protection is faced with severe challenges, mainly focusing on how to identify the subject of the right and the validity of the infringement evidence is uncertain. The subject of the right refers to the scope of the right to own a work and the time limit within which the right can be owned, as well as the territorial scope of the use of the right. The validity of tort evidence refers to the validity of evidence to prove the infringement and to maintain the legal right of the obligee. In this paper, it is impossible to determine whether the authorized person has the right to grant the right to the authorized person, whether the authorized right has been granted exclusively to other rights holders, and can not effectively prove the validity of the authorization. This paper studies the types of basic license information of digital works, including the type of rights, the time range of authorization, the scope of authorization area and the basic information of Licensor / Licensee. This paper analyzes the logical relationship of the right transfer of digital works, and solves the problems of legal authorization and evidence validity proof by abstracting the basic model of right chain, combining form model, establishing set symbol system and designing algorithm. The key research content is to complete the research on the construction method of the right chain of digital works by combining the model, symbol system and construction algorithm. According to the actual work of copyright protection, the author designs and implements the construction system of copyright protection right chain of digital works by applying the above core construction method. Completed the digital work right chain construction method in the practical application process of the test. The innovation of this paper is to abstract two kinds of seven kinds of models to construct the right chain, one set of symbolic description system to construct the right chain and four kinds of construction algorithms.
