【摘要】：社區(qū)養(yǎng)老服務的實踐,推動了我國養(yǎng)老服務體系的建立和老年消費市場的形成,可以說,我國社區(qū)養(yǎng)老服務的發(fā)展取得了一定成就。然而,我國社區(qū)養(yǎng)老服務起步較晚,經驗不足,社區(qū)養(yǎng)老服務社會化、市場化程度不高,各項體制機制也尚不健全等諸多問題慢慢顯現(xiàn)出來。本文認為,在人口老齡化現(xiàn)象日益嚴峻的背景下,要保障社區(qū)養(yǎng)老服務平穩(wěn)發(fā)展,不斷完善我國養(yǎng)老服務體系,務必要加快我國社區(qū)養(yǎng)老服務的法律化進程。文章第一部分主要從社區(qū)養(yǎng)老服務及其法律化的理論進行分析,首先,闡述養(yǎng)老服務和社區(qū)養(yǎng)老服務的概念、性質及特征等,而后分析解釋社區(qū)養(yǎng)老服務的法律化,并將其與社區(qū)養(yǎng)老服務制度化進行比較分析,最后提出我國社區(qū)養(yǎng)老服務法律化的屬性和模式為下文寫作起引導作用。文章第二部分,從社區(qū)養(yǎng)老服務的規(guī)范性、社區(qū)養(yǎng)老服務的制度性、社區(qū)養(yǎng)老服務的地方實踐、社區(qū)養(yǎng)老服務的地方規(guī)范及社區(qū)養(yǎng)老服務的域外考察等方面來闡述社區(qū)養(yǎng)老服務的必要性和可行性,進而為接下來的社區(qū)養(yǎng)老服務法律化的構想做鋪墊。文章第三部分是對我國社區(qū)養(yǎng)老服務法律化的基本構想,主要包括社區(qū)養(yǎng)老服務法律化的理念及社區(qū)養(yǎng)老服務的主要法律制度構建,通過明確政府的職責、社區(qū)養(yǎng)老服務機構的職責等來構建我國社區(qū)養(yǎng)老服務的法律制度。
[Abstract]:The practice of community old-age service has promoted the establishment of the old-age service system and the formation of the elderly consumer market in China. It can be said that the development of the community old-age service in China has made certain achievements. However, many problems such as late start of community pension service, lack of experience, socialization of community pension service, low degree of marketization and imperfect system and mechanism have emerged. This paper holds that in order to ensure the steady development of community pension service and to improve the pension service system of our country, we must speed up the legalization process of community old-age service in the background of aging population. The first part of the article mainly analyzes the community old-age service and its legalization theory. Firstly, it expounds the concept, nature and characteristics of the old-age service and the community old-age service, and then explains the legalization of the community old-age care service. Finally, the author puts forward the characteristics and mode of legalization of community old-age care service, which will guide the following writing. The second part of the article, from the standardization of community pension service, the system of community pension service, the local practice of community pension service, The necessity and feasibility of community old-age service are expounded in terms of the local norms of community old-age service and the extraterritorial investigation of community old-age care service, thus paving the way for the following concept of legalization of community old-age care service. The third part of the article is the basic conception of the legalization of the community old-age service in our country, including the concept of the legalization of the community pension service and the construction of the main legal system of the community old-age care service, through clarifying the responsibility of the government. The duty of community pension service organization to construct the legal system of community pension service in our country.
