【摘要】：隨著世界互聯(lián)網(wǎng)的發(fā)展,我國(guó)跟隨世界的步伐。在并不是所有人都理解“大數(shù)據(jù)”一詞的情況下,我國(guó)已從單純的計(jì)算機(jī)時(shí)代進(jìn)入了大數(shù)據(jù)時(shí)代。在大數(shù)據(jù)時(shí)代下,防止公民隱私權(quán)受到嚴(yán)重侵害已經(jīng)成為一個(gè)巨大的挑戰(zhàn)。在公法已經(jīng)采取行動(dòng)來(lái)保護(hù)公民隱私權(quán)中的個(gè)人信息的時(shí)候,私法領(lǐng)域的民法也應(yīng)該跟上公法的步伐,完善與隱私權(quán)有關(guān)的民法保護(hù),使法律之間能夠做到相互補(bǔ)充和對(duì)應(yīng)。本文從案例著手,主要立足于民法,通過探究大數(shù)據(jù)的技術(shù)運(yùn)用來(lái)發(fā)現(xiàn)大數(shù)據(jù)下隱私權(quán)的特點(diǎn)、價(jià)值及范圍,并從中研究現(xiàn)代社會(huì)下大數(shù)據(jù)對(duì)公民隱私權(quán)的影響,以找出我國(guó)現(xiàn)代民法對(duì)隱私權(quán)保護(hù)的不足之處,并提出相應(yīng)的建議以期完善民法來(lái)保護(hù)在大數(shù)據(jù)時(shí)代的隱私權(quán)。本論文除了引言和結(jié)語(yǔ)外,共包括四個(gè)部分。第一個(gè)部分為案例的引用。通過引用一個(gè)案例,并根據(jù)其爭(zhēng)議點(diǎn)來(lái)提出大數(shù)據(jù)下隱私權(quán)的民法保護(hù)問題。第二部分為大數(shù)據(jù)對(duì)隱私權(quán)保護(hù)的影響。首先,根據(jù)上述案例提出隱私權(quán)的客體在大數(shù)據(jù)時(shí)代難以確定的問題。其次,分析了大數(shù)據(jù)時(shí)代出現(xiàn)的新的侵害隱私權(quán)的類型。最后,對(duì)數(shù)據(jù)時(shí)代所帶來(lái)的又一重要影響進(jìn)行描述,即數(shù)據(jù)的特點(diǎn)加大了隱私權(quán)的保護(hù)難度。第三部分為我國(guó)民法對(duì)大數(shù)據(jù)下隱私權(quán)的保護(hù)不足。先對(duì)我國(guó)民法關(guān)于隱私權(quán)保護(hù)的規(guī)定作出解讀,解釋其優(yōu)勢(shì)和劣勢(shì)。再找出我國(guó)民法對(duì)大數(shù)據(jù)下隱私保護(hù)的滯后點(diǎn),并具體作出說明。第四部分為對(duì)我國(guó)大數(shù)據(jù)下隱私的民法保護(hù)提出的完善建議。先對(duì)域外隱私權(quán)保護(hù)進(jìn)行比較分析。通過分析來(lái)了解域外隱私權(quán)保護(hù)的特點(diǎn),從中分析得出我國(guó)可以借鑒的方面。再針對(duì)我國(guó)民法找出相應(yīng)的完善建議,以便更好的使我國(guó)民法對(duì)隱私權(quán)的保護(hù)與公法對(duì)其保護(hù)相適應(yīng)。
[Abstract]:With the development of the world Internet, our country follows the pace of the world. Under the condition that not everyone understands the word big data, China has moved from the era of simple computer to the era of big data. In big data's time, preventing citizen privacy from being seriously infringed has become a huge challenge. When public law has taken action to protect personal information in the privacy of citizens, the civil law in the field of private law should keep up with the pace of public law, perfect the protection of civil law related to the right to privacy, so that the law can complement and correspond with each other. This article starts from the case, mainly based on the civil law, through exploring big data's technology application to discover the characteristic, the value and the scope of the privacy right under big data, and from it studies the influence on the citizen's privacy under the modern society. In order to find out the deficiency of the privacy protection in the modern civil law of our country, and put forward the corresponding suggestion in order to perfect the civil law to protect the privacy right in big data's time. In addition to the introduction and conclusion, this thesis consists of four parts. The first part is a reference to the case. By citing a case and according to its controversial points, this paper puts forward the civil law protection of privacy under big data. The second part is big data's influence on privacy protection. First of all, according to the above case, the object of privacy is difficult to determine in big data's time. Secondly, it analyzes the new types of invasion of privacy in big data's time. Finally, another important influence brought by the data age is described, that is, the characteristics of data increase the difficulty of privacy protection. The third part is the insufficient protection of the right of privacy under big data in China's civil law. Firstly, the author interprets the protection of privacy in China's civil law and explains its advantages and disadvantages. Then find out the lag point of privacy protection under big data in the civil law of our country, and make concrete explanation. The fourth part is to improve the protection of privacy under big data's civil law. First of all, the protection of the right to privacy outside the comparative analysis. Through the analysis to understand the characteristics of foreign privacy protection, we can draw lessons from the analysis. In order to better suit the protection of the right of privacy in civil law and the protection of public law, the author puts forward the corresponding suggestions for the improvement of the civil law of our country.
