論我國(guó)宅基地使用權(quán)流轉(zhuǎn)的制度構(gòu)建

【摘要】:農(nóng)村宅基地制度具有十分久遠(yuǎn)的歷史淵源,隨著時(shí)代的不斷發(fā)展,農(nóng)村宅基地使用權(quán)制度也經(jīng)歷了幾個(gè)歷史時(shí)期的發(fā)展變化。改革開(kāi)放以來(lái),農(nóng)村的經(jīng)濟(jì)快速地發(fā)展,但是如今的農(nóng)村宅基地制度與農(nóng)村經(jīng)濟(jì)發(fā)展的步伐很不協(xié)調(diào),造成的后果之一就是農(nóng)民的利益能不到有效的保護(hù)。所以,在城鄉(xiāng)一體化逐步推進(jìn)的今天,改革現(xiàn)行的農(nóng)村宅基地使用權(quán)制度,構(gòu)建一套宅基地使用權(quán)的流轉(zhuǎn)制度已勢(shì)在必行。本論文旨在從理論和實(shí)證兩個(gè)方面,結(jié)合中央最新精神和全國(guó)各地在宅基地使用權(quán)流轉(zhuǎn)方面的實(shí)踐經(jīng)驗(yàn),認(rèn)真分析研究我國(guó)宅基地使用權(quán)流轉(zhuǎn)的制度構(gòu)建,從而為激活我國(guó)宅基地市場(chǎng)打下基礎(chǔ)。本選題有著重大的現(xiàn)實(shí)以及理論意義。通過(guò)研究農(nóng)村宅基地使用權(quán)制度,可以推動(dòng)合法化、合理化的農(nóng)村宅基地制度的建立,消除其法律灰色地帶,對(duì)建立完善的社會(huì)主義法治體系具有非常重要的意義。通過(guò)本選題的研究,深挖宅基地使用權(quán)流轉(zhuǎn)的重要價(jià)值,對(duì)于提高土地利用效率,縮小城鄉(xiāng)發(fā)展差距,推進(jìn)社會(huì)主義新農(nóng)村建設(shè)具有重要的現(xiàn)實(shí)意義。長(zhǎng)期以來(lái),受到法律等條件的約束,我國(guó)是一直禁止農(nóng)村宅基地使用權(quán)進(jìn)行流轉(zhuǎn)的。近年來(lái),雖然各地在農(nóng)村宅基地使用權(quán)流轉(zhuǎn)方面有著一定的突破,但是由于受到很多因素的制約,離宅基地自由流轉(zhuǎn)事實(shí)上仍有著較大的差距。本文的主要觀點(diǎn)是破除長(zhǎng)期以來(lái)不讓宅基地使用權(quán)流轉(zhuǎn)的觀念,慢慢解開(kāi)宅基地使用權(quán)流轉(zhuǎn)的一些束縛,探索建立一套能夠讓宅基地使用權(quán)流轉(zhuǎn)的相對(duì)可行的制度,實(shí)現(xiàn)宅基地市場(chǎng)的規(guī)范化。文章先介紹了宅基地使用權(quán)的概念和歷史變遷,之后分析了宅基地使用權(quán)流轉(zhuǎn)的立法、司法現(xiàn)狀及問(wèn)題,并在此基礎(chǔ)上重點(diǎn)分析了全國(guó)各地典型的流轉(zhuǎn)模式,文章最后一部分用較大篇幅提出了自己對(duì)怎樣構(gòu)建宅基地使用權(quán)流轉(zhuǎn)制度的一些想法。本論文的主要?jiǎng)?chuàng)新點(diǎn)在于分析了安徽省、河南省、廣東省的《宅基地管理辦法》,提出了國(guó)家可以借鑒各地《宅基地管理辦法》的閃光點(diǎn),逐步制定《農(nóng)村宅基地管理辦法》;并提出建立宅基地使用權(quán)流轉(zhuǎn)的行政專(zhuān)職機(jī)構(gòu),比如建立宅基地使用權(quán)流轉(zhuǎn)中心、宅基地使用權(quán)流轉(zhuǎn)糾紛解決機(jī)構(gòu)等。本論文主要運(yùn)用了歷史分析、實(shí)證分析的方法,通過(guò)對(duì)宅基地使用權(quán)制度的歷史分析,梳理了宅基地使用權(quán)制度的歷史沿革;通過(guò)實(shí)證分析宅基地使用權(quán)流轉(zhuǎn)的試點(diǎn)情況,分析各地試點(diǎn)的經(jīng)驗(yàn)和弊端。
[Abstract]:The rural homestead system has a very long history origin, with the development of the times, the rural homestead use right system has also experienced several historical periods of development and change. Since the reform and opening up, the rural economy has developed rapidly, but now the rural homestead system and the pace of rural economic development are very inconsistent, one of the consequences is that the interests of farmers can not be effectively protected. Therefore, with the gradual development of urban-rural integration, it is imperative to reform the current system of rural homestead use right and build a transfer system of homestead use right. The purpose of this paper is to analyze and study the construction of the system of the circulation of the right to use the homestead in our country from the theoretical and empirical aspects, combined with the latest spirit of the central government and the practical experience of the circulation of the right to use the homestead in various parts of the country. So as to activate China's homestead market lay the foundation. This topic has great realistic and theoretical significance. By studying the system of rural homestead use right, we can promote the establishment of legalized and rationalized rural homestead system, eliminate its legal grey zone, and have very important significance for the establishment of a perfect socialist legal system. Through the research of this topic, it is of great practical significance to explore the important value of the circulation of the right to use the homestead, to improve the efficiency of land use, to narrow the gap between urban and rural development, and to promote the construction of a new socialist countryside. For a long time, restricted by law and other conditions, our country has been prohibiting the circulation of the right to use the rural homestead. In recent years, although there has been a certain breakthrough in the circulation of the right to use the rural homestead, there is still a big gap between the free circulation of the homestead and the free circulation of the homestead due to the restriction of many factors. The main point of this paper is to break the concept of not allowing the circulation of the right to use the homestead for a long time, slowly untie some constraints of the circulation of the usufruct of the homestead, and explore the establishment of a relatively feasible system for the circulation of the usufruct of the homestead. Realize the standardization of homestead market. This paper first introduces the concept and historical changes of the right to use the homestead, then analyzes the legislation, judicial status and problems of the circulation of the usufruct of the homestead, and on this basis, it focuses on the analysis of the typical circulation mode in various parts of the country. The last part of the article puts forward some ideas about how to construct the circulation system of homestead use right. The main innovation of this paper is to analyze the "Homestead Management methods" of Anhui Province, Henan Province and Guangdong Province, and put forward that the country can draw lessons from the "Homestead Management method" in various places. It also puts forward the establishment of a full-time administrative agency for the circulation of the right to use the homestead, such as the establishment of a center for the circulation of the usufruct of the homestead, a dispute settlement agency for the circulation of the usufruct of the homestead, etc. This paper mainly uses the historical analysis, the empirical analysis method, through the historical analysis of the system of homestead use right, combing the historical evolution of the homestead use right system; through empirical analysis of the circulation of homestead use right pilot situation, Analyze the experiences and disadvantages of the pilot projects.
