【摘要】：生育困難曾今困擾了眾多家庭,但隨著科技的進(jìn)步和醫(yī)療水平的提高,輔助生殖技術(shù)給生育困難的家庭帶來(lái)了希望。代孕是人工輔助生殖技術(shù)的一種,有著強(qiáng)烈的社會(huì)需求。它更是一把雙刃劍,一方面為不孕家庭帶去希望,達(dá)成不孕家庭得到自己的孩子的美好愿望；而另一方面則挑戰(zhàn)了我國(guó)傳統(tǒng)的社會(huì)倫理規(guī)范和法律制度,它顛覆了自然生育方式,也為投機(jī)者們帶來(lái)牟利的機(jī)會(huì)。代孕已然成為一種不容忽視的社會(huì)現(xiàn)象。目前,我國(guó)的代孕立法尚處于空白狀態(tài)。而民間代孕現(xiàn)象的普遍存在迫使我國(guó)在立法上必須有所應(yīng)對(duì)。但本文不過(guò)多的討論是否應(yīng)該開(kāi)放代孕以及開(kāi)放代孕的限度,而是從民法調(diào)整的角度來(lái)探索如何應(yīng)對(duì)代孕生育所引發(fā)的民事法律問(wèn)題。首先通過(guò)比較其他國(guó)家的親子關(guān)系調(diào)整模式,再結(jié)合我國(guó)的現(xiàn)實(shí),從理論上和實(shí)際來(lái)分析合同模式在我國(guó)的可行性,尊重代孕當(dāng)事人的自由選擇,探索出適合我國(guó)的親子關(guān)系調(diào)整模式。再?gòu)谋Ｗo(hù)代孕民事法律關(guān)系當(dāng)事人的角度出發(fā),厘清代孕合同相關(guān)法律關(guān)系。最后為我國(guó)未來(lái)代孕立法提供力所能及的法律建議。
[Abstract]:Fertility difficulties have troubled many families, but with the progress of science and technology and the improvement of medical standards, assisted reproductive technology has brought hope to families with fertility difficulties. Surrogacy is a kind of artificial assisted reproduction technology, which has strong social demand. It is also a double-edged sword. On the one hand, it brings hope to infertile families and achieves the good wish of infertile families to get their own children; on the other hand, it challenges the traditional social ethical norms and legal system of our country. It subverts natural fertility and provides opportunities for speculators to make money. Surrogacy has become a social phenomenon that can not be ignored. At present, the legislation of surrogacy in our country is still blank. The widespread existence of folk surrogacy forced our country to deal with it in legislation. However, this paper does not discuss whether surrogacy should be opened and the limits of surrogate pregnancy, but explores how to deal with the civil legal problems caused by surrogacy from the angle of civil law adjustment. First of all, by comparing the adjustment models of parent-child relationship in other countries and combining the reality of our country, we analyze the feasibility of the contract model in our country theoretically and practically, and respect the free choice of the surrogate parties. To explore a suitable model for the adjustment of parent-child relationship in China. From the angle of protecting the civil legal relationship of surrogate pregnancy, this paper clarifies the related legal relationship of surrogate contract. Finally, it provides legal advice for our country's future surrogacy legislation.
