【摘要】：不同類型的特殊體質(zhì)對(duì)發(fā)生人身?yè)p害所起的作用可能不同,即使是同一特殊體質(zhì),在不同侵權(quán)案件中所起的作用亦可能不同,最高人民法院指導(dǎo)案例24號(hào)無(wú)法滿足多元的實(shí)踐需求。侵害特殊體質(zhì)者案件通常面臨人身?yè)p害賠償責(zé)任的成立認(rèn)定、責(zé)任范圍劃分、損失數(shù)額計(jì)算、損失分擔(dān)等四類問(wèn)題,指導(dǎo)案例24號(hào)僅可指導(dǎo)有關(guān)損失分擔(dān)問(wèn)題的裁判。在行為人被認(rèn)定為構(gòu)成侵權(quán)后,受害人的特殊體質(zhì)將影響責(zé)任范圍的劃分及損失數(shù)額計(jì)算,原則上不影響損失分擔(dān),但在因可歸責(zé)于受害人的原因?qū)е绿厥怏w質(zhì)、受害人存在過(guò)失以及造成例外的顯著失衡結(jié)果時(shí),可減輕侵權(quán)人責(zé)任。
[Abstract]:Different types of special physique may play different roles in the occurrence of personal injury, even if the same special constitution, in different tort cases, may also play a different role, The Supreme people's Court guiding case 24 can not meet the multiple practical needs. The case of infringing special constitution usually faces four kinds of problems, such as the establishment of liability for personal injury compensation, the division of liability scope, the calculation of loss amount and the sharing of loss, etc. The guidance case No. 24 can only guide the judgment on the problem of loss sharing. After the perpetrator is determined to constitute an infringement, the victim's special constitution will affect the division of the scope of responsibility and the calculation of the amount of loss, and in principle will not affect the sharing of losses, but due to the reasons that can be attributed to the victim, the special constitution will be caused. The fault of the victim and the significant imbalance of the exception can reduce the liability of the infringer.
