【摘要】：西方國家創(chuàng)立廣播組織權(quán)的初衷,是促使廣播組織利益與社會公共利益達(dá)到協(xié)調(diào)一致。但隨著數(shù)字網(wǎng)絡(luò)技術(shù)的更新迭代,廣播組織權(quán)的內(nèi)涵不斷拓展,導(dǎo)致兩者利益不可避免地發(fā)生一些沖突。如何平衡廣播組織利益與社會公共利益之間的關(guān)系,既保護(hù)廣播組織的專有權(quán)不受損害,又保障公民能夠依法獲取和使用廣電節(jié)目,是立法機(jī)構(gòu)完善廣播組織權(quán)必須面對的現(xiàn)實問題。本文在分析廣播組織權(quán)與公共利益緣何會發(fā)生沖突的基礎(chǔ)上,提出建立廣播組織權(quán)與公共利益平衡的互動機(jī)制和實現(xiàn)機(jī)制,并從公民言論自由、獲取信息自由、自我實現(xiàn)需要三個方面,探討廣播組織權(quán)與公共利益達(dá)到平衡的策略。
[Abstract]:The original intention of the establishment of broadcasting organization right in western countries is to promote the harmony between broadcasting organization interests and social public interests. However, with the renewal and iteration of digital network technology, the connotation of broadcasting organization rights is constantly expanded, which leads to some inevitable conflicts between the two interests. How to balance the relationship between the interests of broadcasting organizations and the public interests of society, not only to protect the exclusive rights of broadcasting organizations from being harmed, but also to ensure that citizens can obtain and use radio and television programs according to law, It is the realistic problem that the legislature must face to perfect the right of broadcasting organization. Based on the analysis of the conflict between the right of broadcasting organization and the public interest, this paper proposes to establish the interactive mechanism and realization mechanism of the balance between the right of broadcasting organization and the public interest, and to obtain the freedom of information from citizens' freedom of speech. Self-realization needs three aspects to discuss the strategy of balance between broadcasting organization right and public interest.
