【摘要】：隨著社會(huì)經(jīng)濟(jì)的發(fā)展,科學(xué)技術(shù)的進(jìn)步,新聞的傳播變得日益迅速,但伴隨著新聞事業(yè)的發(fā)展,隱性采訪和隱私權(quán)的矛盾也愈演愈烈。一方面,人們?yōu)榱藵M足自己的好奇心,為了適應(yīng)社會(huì)的發(fā)展,通過(guò)電視、報(bào)紙等新聞媒體攝取大量的信息。另一方面,公眾權(quán)利意識(shí)的增強(qiáng),加上信息流通速度之快,范圍之廣,確實(shí)出現(xiàn)了許多泄露個(gè)人私密信息、侵?jǐn)_個(gè)人空間的現(xiàn)象,人們不得不給予個(gè)人隱私權(quán)更多的關(guān)注和保護(hù)。如何處理好隱性采訪中侵害隱私權(quán)的問(wèn)題,已經(jīng)成為各國(guó)新聞界和法學(xué)界的一個(gè)熱門(mén)話題,不過(guò),目前我國(guó)的相關(guān)立法和研究都沒(méi)有一個(gè)明確的定論。隱性采訪作為一種特殊的采訪手段,是媒體獲取新聞素材保證新聞?wù)鎸?shí)性的重要方法之一,也是媒體履行社會(huì)監(jiān)督職責(zé)的重要手段之一,但隱性采訪的運(yùn)用不當(dāng)也會(huì)產(chǎn)生不良后果。新聞工作者在運(yùn)用隱性采訪時(shí),應(yīng)當(dāng)嚴(yán)格堅(jiān)持新聞工作者的職業(yè)道德操守,注重隱性采訪手段運(yùn)用的正當(dāng)性、合法性和合理性,在履行社會(huì)監(jiān)督職能的同時(shí),盡可能地避免對(duì)被采訪者的隱私進(jìn)行不必要的暴露,以保護(hù)被采訪者的合法權(quán)益。本文從隱性采訪、隱私權(quán)的概念入手,分析了隱性采訪與隱私權(quán)產(chǎn)生沖突的原因,并借鑒了英美法系和大陸法系國(guó)家在隱性采訪和隱私權(quán)保護(hù)方面的立法和實(shí)踐經(jīng)驗(yàn),從國(guó)家立法、媒體自律、公民意識(shí)三方面對(duì)我國(guó)解決此問(wèn)題提出了建議,以期能為我國(guó)有關(guān)隱性采訪侵害隱私權(quán)的糾紛提供理論上的參考。
[Abstract]:With the development of social economy and the progress of science and technology, the spread of news becomes more and more rapid, but with the development of journalism, the contradiction between recessive interview and privacy is becoming more and more serious. On the one hand, in order to satisfy their curiosity and adapt to the development of society, people get a lot of information through TV, newspapers and other news media. On the other hand, the increasing awareness of public rights, coupled with the speed and scope of information flow, has indeed led to many phenomena of leaking private information and intruding into personal space. People have to give more attention and protection to personal privacy. How to deal with the infringement of the right to privacy in recessive interviews has become a hot topic in the press and legal circles of various countries. However, there is no clear conclusion about the relevant legislation and research in our country at present. As a special means of interview, recessive interview is one of the important methods for the media to obtain news materials to ensure the authenticity of news, and also one of the important means for the media to perform its social supervision duties. However, the improper use of recessive interviews will also have adverse consequences. When using recessive interviews, journalists should strictly adhere to the professional ethics of journalists, pay attention to the legitimacy, legitimacy and reasonableness of the use of recessive interview means, and perform social supervision functions at the same time. Avoid unnecessary exposure of the interviewee's privacy to protect the legitimate rights and interests of the interviewee. This paper starts with the concept of recessive interview and privacy, analyzes the causes of the conflict between recessive interview and privacy, and draws lessons from the legislation and practice of recessive interview and privacy protection in the countries of Anglo-American law system and civil law system. This paper puts forward some suggestions on how to solve this problem from the aspects of national legislation, media self-discipline and citizen consciousness, in order to provide a theoretical reference for the disputes about the infringement of privacy rights by recessive interviews in our country.
