【摘要】：脫法行為制度在理論與實(shí)踐上被虛偽行為制度所遮蔽。從脫法行為與虛偽行為發(fā)展的歷史來看,脫法行為與虛偽行為僅存在部分重疊關(guān)系,并且脫法行為制度是從法律行為合法性層面進(jìn)行的外在評價(jià),而虛偽行為制度則是從意思表示的真實(shí)性角度進(jìn)行的當(dāng)事人真意探求。從比較法上來看,對脫法行為進(jìn)行明確規(guī)定并對強(qiáng)行法規(guī)進(jìn)行實(shí)質(zhì)解釋是法律發(fā)展趨勢,我國應(yīng)在未來民法典中明確規(guī)定脫法行為。
[Abstract]:In theory and practice, the system of delegitimization is obscured by the system of hypocrisy. From the history of the development of delegitimization and hypocrisy, there is only a partial overlap between delegitimization and hypocrisy, and the system of delegitimization is an external evaluation of the legality of the legal act. The system of hypocrisy is to explore the truth of the parties from the point of view of the authenticity of the expression of intention. From the point of view of comparative law, it is the trend of law development to clearly stipulate the behavior of taking off the law and to interpret the law by force, which should be clearly stipulated in the future civil code of our country.
