【摘要】：分時(shí)度假是結(jié)合分時(shí)與交換概念的新型旅游消費(fèi)品,對其上衍生的分時(shí)度假權(quán)益權(quán)屬性質(zhì)的界定,我國學(xué)術(shù)界提出所有權(quán)說、他物權(quán)說、準(zhǔn)物權(quán)說、債權(quán)說的觀點(diǎn),司法實(shí)踐中則以債權(quán)說為主流。但是,分時(shí)度假權(quán)益本身具有異于債權(quán)的權(quán)利特質(zhì),體現(xiàn)了一定的物權(quán)效力,盡管分時(shí)度假制度設(shè)計(jì)的"分時(shí)"特點(diǎn)及處分權(quán)的限制削弱了權(quán)利自身的絕對性和排他性,但從物權(quán)之對抗性、流通性、穩(wěn)定性因素來分析,應(yīng)該將分時(shí)度假權(quán)益歸入物權(quán)體系進(jìn)行調(diào)整。一方面,分時(shí)度假權(quán)益具有促進(jìn)物的有效利用、保障利益平衡、維護(hù)物的利用秩序的存在價(jià)值,且分時(shí)度假的法律特征、內(nèi)容與用益物權(quán)相吻合;另一方面,分時(shí)度假權(quán)益的期限性、權(quán)利主體的多元性、權(quán)利構(gòu)成的復(fù)合性,以及主體對標(biāo)的的不完全處分的特性,有悖于傳統(tǒng)用益物權(quán),故將其視為一種特殊用益物權(quán)更為妥當(dāng)。
[Abstract]:Timeshare is a new type of tourist consumer goods which combines the concept of time-sharing and exchange, and defines the property of the rights and interests of time-sharing holidays derived from it. The academic circles of our country put forward the theory of ownership, his theory of real right, the theory of quasi-real right and the view of creditor's rights. In judicial practice, the theory of creditor's rights is the mainstream. However, the rights and interests of timeshare itself are different from those of creditor's rights and embody the effect of real right, although the "time-sharing" characteristics of time-sharing system and the restriction of disposition rights weaken the absolute and exclusive nature of the rights themselves. However, from the antagonism, circulation and stability of real right, the time-sharing rights and interests should be adjusted into the real right system. On the one hand, the rights and interests of timeshare have the value of promoting the effective use of objects, ensuring the balance of interests, maintaining the order of utilization of the objects, and the legal characteristics and contents of the time-sharing holidays are consistent with the usufruct rights; on the other hand, The duration of the rights and interests of timesharing, the pluralism of the subject of rights, the compounding of the composition of the rights, and the characteristics of the subject's incomplete disposition of the object are contrary to the traditional usufructuary right, so it is more appropriate to regard it as a special usufruct right.
