從“商標(biāo)混淆”再看“非誠(chéng)勿擾”案件

【摘要】:判斷"非誠(chéng)勿擾"節(jié)目究竟有沒(méi)有侵犯在先注冊(cè)商標(biāo)權(quán)利,應(yīng)首先明確中國(guó)商標(biāo)侵權(quán)判斷的標(biāo)準(zhǔn),再照侵權(quán)標(biāo)準(zhǔn),進(jìn)一步明確本案侵權(quán)是否最終成立。本案中,江蘇電視臺(tái)的"非誠(chéng)勿擾"與金阿歡的在先商標(biāo)未構(gòu)成相同服務(wù)上的相同商標(biāo),并且,二者服務(wù)也未形成類似,在沒(méi)有明顯反證情形下,可以直接江蘇電視臺(tái)侵權(quán)不成立。本文在此基礎(chǔ)上試想了消費(fèi)者混淆情形,得出的結(jié)論是,消費(fèi)者混淆也不會(huì)存在,因而更進(jìn)一步證明了江蘇電視臺(tái)侵權(quán)不成立。
[Abstract]:To judge whether the program "if you are the one" has infringed the right of registered trademark, we should first make clear the standard of judging the infringement of trademark in China, and then, according to the standard of infringement, further determine whether the infringement of this case is finally established. In this case, the "if you are the one" trademark of Jiangsu TV Station and Jin Ahuan's previous trademark did not constitute the same trademark on the same service, and the two services did not form the same, in the absence of obvious countervailing cases, Can direct Jiangsu TV station tort does not hold water. On the basis of this, this paper tries to imagine the situation of consumer confusion, and draws the conclusion that consumer confusion will not exist, so it further proves that the infringement of Jiangsu TV station is untenable.
