【摘要】：隨著電子商務(wù)的迅速發(fā)展,互聯(lián)網(wǎng)金融行業(yè)也日益興起,其作為一種金融創(chuàng)新模式——互聯(lián)網(wǎng)與金融的融合,不僅是科技的創(chuàng)新,更是為廣大網(wǎng)購(gòu)消費(fèi)主體提供了便利。作為互聯(lián)網(wǎng)金融的主體之一—網(wǎng)購(gòu)消費(fèi)者,其后悔權(quán)不僅是實(shí)現(xiàn)網(wǎng)絡(luò)金融公平交易的重要途徑,而且有利于網(wǎng)購(gòu)消費(fèi)者權(quán)益的保護(hù)。然而,我國(guó)網(wǎng)購(gòu)消費(fèi)者后悔權(quán)在實(shí)現(xiàn)過(guò)程中存在著權(quán)利被虛設(shè),缺乏立法保障的情形,因此需要完善我國(guó)后悔權(quán)制度。在本文中筆者將從消費(fèi)者后悔權(quán)的產(chǎn)生背景,立法現(xiàn)狀來(lái)分析我國(guó)目前消費(fèi)者后悔權(quán)中存在問(wèn)題,并提出相關(guān)的解決對(duì)策。
[Abstract]:With the rapid development of electronic commerce, the Internet financial industry is also rising day by day. As a financial innovation mode, the integration of Internet and finance is not only the innovation of science and technology, but also provides convenience for the vast number of consumers of online shopping. As one of the main body of Internet finance, the right of repentance is not only an important way to realize the fair transaction of online finance, but also beneficial to the protection of consumers' rights and interests. However, in the process of realizing the right of repentance, there is a lack of legislative protection, so it is necessary to perfect the system of the right of regret in our country. In this paper, the author will analyze the problems existing in the consumer's right of regret in our country from the background of consumer's right of regret and the present situation of legislation, and put forward some relevant countermeasures.
