不動產(chǎn)預告登記效力研究

【摘要】:不動產(chǎn)預告登記制度隸屬于物權法領域中的不動產(chǎn)登記制度,預告登記是不動產(chǎn)登記中不可或缺而又極其獨特的一種登記類型。之所以特殊,原因在于其他類型的不動產(chǎn)登記一般都是將已經(jīng)完成的不動產(chǎn)物權變動記載于冊;然而預告登記所記載的并不是一項不動產(chǎn)物權,而是一項債權請求權,這項債權請求權在將來經(jīng)過義務人的履行后會發(fā)生不動產(chǎn)物權變動的法律效果。預告登記賦予被登記的債權請求權以物權的某些效力,可以排除其后他人對不動產(chǎn)所實施的與權利人的請求權相抵觸的處分行為,以確保將來能夠順利發(fā)生不動產(chǎn)物權變動的法律結果。換言之,預告登記并不能實現(xiàn)當下的經(jīng)濟利益,而是為日后發(fā)生的不動產(chǎn)物權變動提供一種保障。作為一種確保不動產(chǎn)物權變動切實發(fā)生的擔保手段,預告登記具有自主性、臨時性、附隨性,并且兼具物權性和債權性。預告登記制度是不動產(chǎn)物權法領域中一項不可或缺的制度,最早出現(xiàn)在18世紀的普魯士法中,《德國民法典》正式以法典的形式將該制度確立下來,后來世界上許多國家和地區(qū)如日本、我國臺灣地區(qū)在制定相關法律時都對該制度予以采納和承繼。我國2007年頒布的《物權法》對不動產(chǎn)預告登記制度的適用范圍、效力以及失效情形等方面作出了規(guī)定,這標志著這項重要的不動產(chǎn)登記制度在我國物權法領域的正式建立。效力問題是預告登記制度的核心問題,只有具備完整的、較強的效力,預告登記制度才能充分發(fā)揮其保障物權變動實現(xiàn)的功能。考察境外立法可知,在一些對不動產(chǎn)預告登記制度規(guī)定比較完善的國家和地區(qū),如德國、日本,該項制度通常都具備保全權利、保全順位以及破產(chǎn)保護的效力,并且對于預告登記后再處分行為的效力各國(地區(qū))也有其不同的立法模式。我國《物權法》對預告登記的效力予以明確,即當事人雙方申請了預告登記后,登記義務人在沒有經(jīng)過登記權利人同意的情況下,不得對登記不動產(chǎn)實施再次處分的行為,即使義務人實施了再次處分行為,該處分行為也不會導致物權變動。這條規(guī)定體現(xiàn)出了預告登記具有保全權利的效力,也可以說明,對于預告登記后再處分行為的效力我國立法采絕對無效原則。關于預告登記的其他效力,我國立法未予確認�?梢钥闯�,我國《物權法》僅用一個條文對預告登記的效力作出規(guī)定,顯然比較簡略,不夠完善,不能充分發(fā)揮預告登記制度的功能,也不利不動產(chǎn)交易的繁榮發(fā)展。本文共分為四大部分,由五個章節(jié)組成。本文以發(fā)生在江蘇省的一個司法案例作為切入點,引出我國不動產(chǎn)預告登記效力在實踐操作中所存在的問題。本文的第一部分由兩個章節(jié)組成,闡述不動產(chǎn)預告登記制度的基本理論,包括研究背景及意義、國內外學者的研究綜述、不動產(chǎn)預告登記的內涵、性質、價值選擇以及歷史演變過程;第二部分主要對大陸法系國家的德國、日本以及我國臺灣地區(qū)的不動產(chǎn)預告登記效力進行論述;第三部分主要介紹我國法律法規(guī)對預告登記效力的規(guī)定,并對我國的預告登記效力進行評析;第四部分,在借鑒其他國家經(jīng)驗的基礎上結合我國目前的社會經(jīng)濟發(fā)展現(xiàn)狀為我國建立更加全面系統(tǒng)的不動產(chǎn)預告登記效力體系提出相應建議。以期使我國的不動產(chǎn)預告登記制度更加全面、具體,具備可操作性,更好地發(fā)揮不動產(chǎn)預告登記制度保障交易安全的功能,促進我國不動產(chǎn)交易市場的繁榮發(fā)展。
[Abstract]:The system of real property registration is subordinate to the real property registration system in the field of real property law. The notice registration is an indispensable and extremely unique registration type in the registration of real estate. The reason is that other types of real property registration are generally recorded in the real property changes that have been completed; however, it is a preview. The registration is not a real property right, but a claim of claim. The claim will have the legal effect of the change of real property after the performance of the obligor in the future. The notice that the registration gives the right to the registered claim, with certain effect of the real right, can exclude the subsequent implementation of the real property. The action that contradict the right holder's claim is to ensure the legal result of the change of real property right in the future. In other words, the advance notice registration does not realize the current economic interests, but provides a guarantee for the change of real property right in the future. The pre registration system is an indispensable system in the field of real property law, which first appeared in the Prussian law in eighteenth Century, and the German Civil Code formally established the system in the form of code in the form of the code of law in eighteenth Century, and later many years in the world. The state and region, such as Japan, and the Taiwan region of our country adopt and inherit the system in the formulation of relevant laws. In 2007, the property law promulgated in our country stipulates the scope, effectiveness and failure situation of the registration system of real property preview, which marks the important real property registration system in China's property law. The issue of validity is the core of the notice registration system. Only with a complete and strong effect, the pre registration system can give full play to its function of ensuring the realization of the change in property rights. The system usually has the effectiveness of preserving the rights, preserving the order and the bankruptcy protection, and there are different legislative modes for the effective countries (regions) of the action after the announcement of the registration. In the case of the consent of the registrant, no further disposition of the registered real estate shall be carried out. Even if the obligor has carried out the action again, the action will not lead to a change in property rights. This provision embodies the effect of the pre registration registration with the protection of the right, and may also indicate that the act of dispose of the registration after the registration is made. As to the principle of absolute invalidity in China's legislation, the legislation of our country has not been confirmed on the other effects of the registration of pre registration. It can be seen that the property law of China stipulates only one provision on the validity of the notice registration. It is obviously relatively simple, not perfect, and can not give full play to the function of the advance notice system and the prosperity of the real estate transaction. This article is divided into four parts. This article is composed of five chapters. This article, taking a judicial case in Jiangsu as a breakthrough point, leads to the problems in the practice of the validity of the registration of real estate in China. The first part of this article is composed of two chapters, and expounds the basic theory of the system of the real estate notice registration, including the research. The background and significance, the domestic and foreign scholars' research summary, the connotation, nature, value choice and historical evolution process of the real estate forecast registration; the second part mainly discusses the registration validity of the real estate forecast in the German, Japanese and Taiwan regions of the continental law system; the third part mainly introduces the laws and regulations of our country to the advance notice. On the basis of the experience of other countries and the present situation of our country's social and economic development, the fourth part puts forward some suggestions for the establishment of a more comprehensive and systematic system of the validity of the registration of real estate in our country on the basis of the experience of other countries. Comprehensive, specific, operable, better use of the real estate notice registration system to protect the security of the transaction, and promote the prosperity and development of the real estate market in China.
