【摘要】：地役權(quán)制度作為一項古老的用益物權(quán)制度長久以來都發(fā)揮著重要的作用,在我國卻是直到2007年《物權(quán)法》頒布時才予以正式確立。然而盡管我國立法為地役權(quán)制度正了名,實踐中人們對于地役權(quán)制度卻仍然感到陌生,地役權(quán)也并未有效的發(fā)揮出其最大的作用。這種情況究其原因,歸根結(jié)底是因為我國立法對地役權(quán)的規(guī)定太過簡潔和粗糙,給實踐操作帶來了種種問題,使得地役權(quán)制度的功能無法最大限度的發(fā)揮出來。商品經(jīng)濟(jì)發(fā)展的步伐越來越快,人們對于土地利用的要求越來越高,使得如何激活地役權(quán)制度、讓它更好的服務(wù)于經(jīng)濟(jì)社會成為一個擺在我們面前的現(xiàn)實問題。筆者在深刻認(rèn)識到這一問題的嚴(yán)重性后,決然要為我國地役權(quán)制度的立法完善盡一份綿薄之力。全文的寫作筆者采用了一個比較傳統(tǒng)的思路,嚴(yán)格沿著一條從“是什么”到“為什么”再到“怎么辦”的思維路線,首先闡述了地役權(quán)制度的一些基本問題作為論文研究的基礎(chǔ)和立足點,這些基本的問題包括地役權(quán)的內(nèi)涵及權(quán)利屬性、地役權(quán)的特點、地役權(quán)的功能及地役權(quán)在中國的發(fā)展。接著分析了我國在地役權(quán)制度方面目前的立法現(xiàn)狀以及存在的一些問題。這些問題分散在地役權(quán)適用范圍、地役權(quán)主體范圍、地役權(quán)登記制度以及地役權(quán)取得事由和消滅事由這五大領(lǐng)域中。在明確了這些問題以后,帶著疑問,筆者追尋到了國外關(guān)于地役權(quán)的相關(guān)規(guī)定,在對法國、德國、美國等國家的地役權(quán)立法作了分析之后,總結(jié)出一些對我國有益的先進(jìn)做法。在這些工作完成之后,論文的主體部分,也即對我國地役權(quán)制度提出完善建議的部分粉墨登場。在這一部分中,筆者對應(yīng)著前文發(fā)現(xiàn)的我國地役權(quán)法律制度中存在的問題,得出了應(yīng)擴(kuò)大地役權(quán)的適用范圍、擴(kuò)大地役權(quán)的主體范圍、明確地役權(quán)的登記規(guī)則、增加地役權(quán)的取得事由、明細(xì)地役權(quán)的消滅事由的結(jié)論,形成了既立足我國國情,又吸收了國外先進(jìn)理念的一套立法建議,期望能夠為地役權(quán)制度在我國的順利發(fā)展做出一份貢獻(xiàn)。
[Abstract]:As an ancient usufruct right system, easement system has played an important role for a long time, but it was not formally established until 2007 when the Real right Law was promulgated in our country. However, although the legislation of our country is the right name for the easement system, people still feel strange about the easement system in practice, and the easement has not played its biggest role effectively. In the final analysis, the reason for this situation is that the stipulation of easement in our legislation is too concise and rough, which brings all kinds of problems to the practical operation, which makes the function of easement system unable to be brought into play to the maximum extent. The pace of the development of commodity economy is getting faster and faster, and the demand for land use is higher and higher, so how to activate the easement system and make it better serve the economy and society has become a realistic problem in front of us. After deeply realizing the seriousness of this problem, the author is determined to do his utmost to perfect the legislation of easement system in our country. The author adopts a more traditional way of thinking, strictly following a thinking line from "what is" to "why" to "how to do". First of all, some basic problems of easement system are expounded as the basis and foothold of the thesis. These basic problems include the connotation and property of easement, the characteristics of easement, the function of easement and the development of easement in China. Then it analyzes the current legislative situation and some problems in the easement system in our country. These problems are scattered in the scope of application of easement, the scope of subject of easement, the registration system of easement, the reason of obtaining easement and the cause of eliminating easement. After clarifying these problems, with doubt, the author traced down the relevant provisions about easement in foreign countries. After analyzing the easement legislation of France, Germany, the United States and other countries, the author summed up some beneficial advanced practices for our country. After the completion of these works, the main part of the paper, that is to say, put forward some suggestions to improve the easement system in China. In this part, the author points out that the scope of application of easement should be expanded, the subject scope of easement should be expanded, and the registration rules of easement should be clarified. The conclusion that the reasons for obtaining easements and the reasons for the elimination of easements are added has formed a set of legislative proposals based on the national conditions of our country and absorbing the advanced concepts of foreign countries. Expect to make a contribution to the smooth development of easement system in our country.
