【摘要】：作品的使用方式在數(shù)字化技術(shù)和信息高速公路技術(shù)的發(fā)展下,發(fā)生了深刻的變化,這種變化是前所未有的深刻。與這種深刻變化應(yīng)對(duì)的是著作權(quán)的擴(kuò)張也隨之?dāng)U張,特別是技術(shù)保護(hù)措施受到法律保護(hù)之后,著作權(quán)擴(kuò)張達(dá)到了一種前所未有的水平。網(wǎng)絡(luò)環(huán)境下作品法律保護(hù)的平衡目標(biāo)如何實(shí)現(xiàn),成為諸多學(xué)者關(guān)注的問(wèn)題。本文從作品使用方式與作品法律保護(hù)關(guān)系的角度,對(duì)作品使用方式進(jìn)行了歷史回顧,分析了網(wǎng)絡(luò)環(huán)境下作品的使用方式之變化以及相應(yīng)的作品法律保護(hù)制度的變化,并且對(duì)網(wǎng)絡(luò)環(huán)境下作品法律保護(hù)失衡的原因進(jìn)行了分析,對(duì)作品法律保護(hù)目標(biāo)在網(wǎng)絡(luò)環(huán)境下如何再次平衡提出了自己的觀點(diǎn)。第一部分對(duì)作品使用方式的歷史變化與發(fā)展做了回顧,論述了作品使用方式的發(fā)展與技術(shù)發(fā)展的關(guān)系,從對(duì)作品使用方式的歷史發(fā)展中,作品使用方式的發(fā)展隨著技術(shù)的進(jìn)步呈現(xiàn)一種加速度發(fā)展的趨勢(shì),并且這種發(fā)展隨著技術(shù)發(fā)展速度越來(lái)越快,作品使用方式的發(fā)展越來(lái)越偏離著作權(quán)人的掌控。第二部分論述了作品使用方式和作品法律保護(hù)的關(guān)系。首先從靜態(tài)層面論述了著作權(quán)以作品使用方式為表征來(lái)構(gòu)建著作權(quán)權(quán)利人的權(quán)能體系,并通過(guò)法律對(duì)其著作權(quán)權(quán)能的限制來(lái)追求作品法律保護(hù)平衡目標(biāo)的實(shí)現(xiàn)。其次從動(dòng)態(tài)層面論述了隨著作品使用方式的變化,通過(guò)對(duì)著作權(quán)權(quán)能以及相關(guān)法律的變動(dòng)來(lái)追求作品法律保護(hù)平衡目標(biāo)再次實(shí)現(xiàn)。第三部分論述了網(wǎng)絡(luò)環(huán)境下作品法律保護(hù)的失衡。網(wǎng)絡(luò)環(huán)境下使用方式發(fā)展的更加偏離著作權(quán)人的掌控,給其經(jīng)濟(jì)利益帶來(lái)巨大消極影響,為應(yīng)對(duì)作品使用方式的發(fā)展的不可控,信息網(wǎng)絡(luò)傳播權(quán)得以確立并且技術(shù)保護(hù)措施得以立法保護(hù)。然而這一新的以平衡為目標(biāo)的立法帶來(lái)了新的不平衡,傳統(tǒng)環(huán)境下作品法律保護(hù)的兩個(gè)平衡工具—合理使用制度和法定許可制度,其調(diào)整作品法律保護(hù)目標(biāo)平衡制度設(shè)計(jì)之愿景在網(wǎng)絡(luò)環(huán)境新一輪立法下已經(jīng)失調(diào)。第四部分論述了網(wǎng)絡(luò)環(huán)境下作品法律保護(hù)如何在新的時(shí)代背景中達(dá)到平衡,首先要對(duì)技術(shù)保護(hù)措施予以一定的規(guī)制;其次對(duì)合理使用制度進(jìn)行完善;最后對(duì)法定許可制度進(jìn)行完善。
[Abstract]:The use of the works has undergone profound changes in the development of digital technology and information highway technology. This change is unprecedented. The expansion of copyright is also expanded with this profound change, especially after the protection of technical protection, the expansion of copyright has reached a kind of before. There are some levels. In the network environment, how to achieve the balance of the legal protection of the works has become a concern of many scholars. From the angle of the relationship between the use of works and the legal protection of the works, this paper makes a historical review of the way of the use of works, analyzes the changes in the way of use of works under the network environment, and the corresponding legal protection of the works. The changes of the protection system and the reasons for the imbalance of the legal protection of the works under the network environment are analyzed, and the views on how to rebalance the target of the legal protection of the works in the network environment are put forward. The first part reviews the historical changes and development of the mode of use of the works, and discusses the development and technical development of the use of the works. From the historical development of the way of use of works, the development of the use of works presents a trend of acceleration with the progress of technology, and with the rapid development of technology, the development of the use of works is more and more deviating from the control of the copyright owners. The second part discusses the way of use of the works. The relationship between the legal protection of the works and the legal protection of the works. First, from the static level, the author expounds the construction of copyright owner's power and energy system with the use of works as the representation of copyright, and seeks the realization of the goal of the balance of legal protection through the restriction of the copyright rights of the works by law. Secondly, the change of the mode of use of works is discussed from the dynamic level. The third part discusses the imbalance of the legal protection of the works under the network environment. The development of the use of the works in the network environment is more deviated from the control of the copyright owners, and has a huge negative impact on its economic benefits, in order to deal with the works. The development of the mode of use is uncontrollable, the right of information network communication is established and the technical protection measures are protected by legislation. However, this new balance oriented legislation brings new imbalances, the two balance tools for the legal protection of works under the traditional environment - the rational use system and the legal licensing system, which adjust the law of the works The vision of the design of the system of protecting the balance of the target has been disadjusted in the new round of legislation of the network environment. The fourth part discusses how the legal protection of the works in the network environment is balanced in the new era background. First, it is necessary to regulate the technical protection measures; secondly, to perfect the rational use system; and finally to the legal licensing system. Degree is perfected.
