【摘要】：我國《侵權(quán)責任法》第八十七條規(guī)定的責任應該名為"建筑物上不明拋墜物損害責任"。該責任的適用條件包括:致害物應是建筑物上的拋墜物、加害人無法確定、責任人是"可能加害的建筑物的使用人"。從本質(zhì)上講,本責任是一種道義補償責任,而非真正意義上的侵權(quán)賠償責任,因此,在適用本責任時應當注意其部分補償性、補充性和按份性,以充分平衡本責任中受害人與補償人間的利益。
[Abstract]:The liability stipulated in Article 87 of our country's Tort liability Law should be called "liability for damage caused by unknown falling objects on buildings". The applicable conditions of the liability include: the damage should be a falling object on the building, the perpetrator cannot be determined, and the person responsible is "the user of the building that may cause harm". In essence, this responsibility is a duty of moral compensation, not a liability for tort in the true sense. Therefore, in the application of this responsibility, attention should be paid to its partial compensatory, supplementary and proportionate nature. In order to fully balance the interests of victims and compensation in this responsibility.
