【摘要】：信息技術(shù)的快速發(fā)展使隱私權(quán)的保護(hù)面臨許多前所未有的問題。2013年中央電視臺(tái)3.15晚會(huì)讓廣大網(wǎng)民認(rèn)識(shí)了Cookie這個(gè)網(wǎng)絡(luò)技術(shù)名詞,Cookie技術(shù)被歸結(jié)為竊取網(wǎng)絡(luò)用戶隱私的重要技術(shù)手段。Cookie技術(shù)提高了網(wǎng)絡(luò)用戶體驗(yàn),促進(jìn)了互聯(lián)網(wǎng)行業(yè)的發(fā)展,但也存在著危害用戶隱私的可能性。如何對(duì)利用Cookie技術(shù)侵犯用戶隱私的行為進(jìn)行有效規(guī)制成為目前亟需解決的問題。目前,Cookie技術(shù)的隱私安全問題,絕大多數(shù)是從技術(shù)的角度來研究,從法學(xué)角度的研究并不是很充分。本文綜合運(yùn)用比較法、實(shí)證法、歷史分析法,對(duì)Cookie技術(shù)的起源和發(fā)展進(jìn)行介紹,結(jié)合對(duì)個(gè)人隱私和個(gè)人信息內(nèi)涵、特征與區(qū)別的理論把握,分析Cookie技術(shù)個(gè)人信息保護(hù)方面可能存在的缺陷,通過對(duì)我國目前應(yīng)對(duì)Cookie技術(shù)隱私問題的現(xiàn)狀分析,對(duì)比參考?xì)W盟的做法,指出我國Cookie技術(shù)隱私問題亟需進(jìn)行立法規(guī)制,并需要充分發(fā)揮行業(yè)自律的作用和加強(qiáng)用戶保護(hù)意識(shí),提出了一些具體的應(yīng)對(duì)措施。本文分為五章。第一章是網(wǎng)絡(luò)時(shí)代Cookie技術(shù)的使用。本章首先介紹了Cookie技術(shù)的起源和類型,然后闡述了互聯(lián)網(wǎng)時(shí)代Cookie技術(shù)發(fā)揮的巨大作用,最后分析了可能利用Cookie技術(shù)侵犯用戶隱私的行為。第二章是隱私與個(gè)人信息。本章從理論層面介紹分析了隱私和隱私權(quán)的概念,以及和個(gè)人數(shù)據(jù)(資料)、個(gè)人信息的關(guān)系。第三章是我國應(yīng)對(duì)Cookie技術(shù)隱私問題的現(xiàn)狀。本章首先對(duì)我國目前規(guī)制Cookie技術(shù)的立法進(jìn)行了梳理,然后指出我國目前立法規(guī)制存在的問題,最后介紹了我國行業(yè)自律的現(xiàn)狀。第四章是歐盟應(yīng)對(duì)Cookie技術(shù)隱私問題的現(xiàn)狀。本章通過對(duì)歐盟規(guī)制Cookie的立法梳理和相關(guān)機(jī)構(gòu)的介紹,分析了歐盟立法規(guī)制Cookie技術(shù)的焦點(diǎn)問題。第五章是我國應(yīng)對(duì)Cookie技術(shù)隱私問題對(duì)策建議。基于前面章節(jié)的理論框架,通過對(duì)我國如何應(yīng)對(duì)Cookie技術(shù)隱私問題的思考,提出了需要從國家、行業(yè)和個(gè)體三個(gè)層面的角度來應(yīng)對(duì),并提供了一些具體的措施建議。
[Abstract]:With the rapid development of information technology, the protection of privacy faces many unprecedented problems. The 2013 CCTV 3. 15 evening party made the vast number of Internet users aware of cookie, a term used in network technology, which is attributed to stealing the privacy of Internet users. Cookie technology improves the network user experience. Promote the development of the Internet industry, but there is also the possibility of endangering user privacy. How to regulate the behavior of infringing users' privacy by cookie technology becomes a problem that needs to be solved. At present, most of the privacy security problems of Cookie technology are studied from the point of view of technology, but not from the point of view of law. This paper introduces the origin and development of cookie technology by means of comparative method, empirical method and historical analysis method, combining with the theoretical understanding of the connotation, characteristics and differences of personal privacy and personal information. This paper analyzes the possible defects in the protection of personal information of cookie technology, through the analysis of the current situation of dealing with the privacy problems of cookie technology in China, and points out that the problem of cookie technology privacy in our country needs to be regulated by legislation by referring to the practices of the European Union. We need to give full play to the role of industry self-discipline and strengthen the awareness of user protection, and put forward some specific countermeasures. This paper is divided into five chapters. The first chapter is the use of cookie technology in the network age. This chapter first introduces the origin and types of cookie technology, then expounds the great role of cookie technology in the Internet era, and finally analyzes the possible use of cookie technology to violate the privacy of users. The second chapter is about privacy and personal information. This chapter introduces and analyzes the concepts of privacy and privacy, and the relationship between privacy and personal data. The third chapter is about the status of cookie privacy in China. This chapter firstly combs the current legislation of cookie technology in our country, then points out the existing problems of our country's current legislation regulation, and finally introduces the present situation of industry self-discipline in our country. The fourth chapter is the current situation of EU to deal with cookie technology privacy. This chapter analyzes the focus of EU legislation on cookie regulation through the introduction of EU legislation on cookie regulation and the introduction of relevant institutions. The fifth chapter is our country to deal with cookie technology privacy issues countermeasures. Based on the theoretical framework of the previous chapters, this paper puts forward some suggestions on how to deal with the privacy of cookie technology in China from the perspectives of country, industry and individual.
