【摘要】:不動(dòng)產(chǎn)作為每一個(gè)人都會(huì)用到的東西,時(shí)至今日,已經(jīng)不僅僅是我們所能“看得見,摸得著”的實(shí)物,而是變?yōu)榕c我們利益息息相關(guān)的不動(dòng)產(chǎn)權(quán)能。隨著我國市場化程度不斷加深,越來越多的東西被投入到流通環(huán)節(jié)之中,實(shí)現(xiàn)商品化。與此不相適應(yīng)的是,由于我國相關(guān)法律規(guī)定還不健全,給老百姓的日常交易帶來了極大的不便。尤其是我國的不動(dòng)產(chǎn)交易,已成為國民經(jīng)濟(jì)的重要組成部分,缺少一個(gè)統(tǒng)一的不動(dòng)產(chǎn)登記體系,嚴(yán)重制約著我國的經(jīng)濟(jì)發(fā)展。因此,建設(shè)不動(dòng)產(chǎn)統(tǒng)一登記體系的計(jì)劃被我國政府提上日程。然而,正如我們所看到的,這個(gè)計(jì)劃因?yàn)榉N種原因,遭到一再拖延。作為這個(gè)計(jì)劃的具體落實(shí)者,地方政府難辭其咎。在這樣的形勢(shì)下,系統(tǒng)地梳理馬克思土地產(chǎn)權(quán)理論與不動(dòng)產(chǎn)登記制度在我國的發(fā)展歷程,以及深入研究地方政府推進(jìn)不動(dòng)產(chǎn)統(tǒng)一登記體系建設(shè)的問題具有重要的理論和現(xiàn)實(shí)意義。 通過深入分析政府、市場和農(nóng)村這三大因素與地方政府推進(jìn)不動(dòng)產(chǎn)統(tǒng)一登記體系建設(shè)的相互影響,,一是了解地方政府在推進(jìn)這項(xiàng)工作的時(shí)候?qū)?huì)面臨的問題。從政府自身角度來看,部門利益爭奪、機(jī)構(gòu)設(shè)置不合理、工作積極性不高、歷史遺留問題、管理機(jī)制不健全是阻礙其開展工作的重要原因;從市場角度來看,只有投機(jī)分子會(huì)給政府工作制造麻煩;從農(nóng)村角度來看,集體土地產(chǎn)權(quán)模糊以及土地流轉(zhuǎn)方式不科學(xué)也會(huì)帶來一定程度的負(fù)面影響。二是了解地方政府在推進(jìn)這項(xiàng)工作的時(shí)候?qū)?huì)帶來一系列可預(yù)見的益處。從政府自身角度來看,為不動(dòng)產(chǎn)信息聯(lián)網(wǎng)、征收房產(chǎn)稅、建立公開透明的公務(wù)員財(cái)產(chǎn)申報(bào)制度都提供了極大的便利;從市場角度來看,更加安全的不動(dòng)產(chǎn)交易平臺(tái)、抑制房價(jià)過快上漲、摸清全國樓市情況有助于促進(jìn)我國經(jīng)濟(jì)的良性發(fā)展;從農(nóng)村角度來看,有助于加快農(nóng)村土地改革,為農(nóng)村土地流轉(zhuǎn)提速。 針對(duì)以上問題,地方政府應(yīng)當(dāng)促進(jìn)不動(dòng)產(chǎn)登記機(jī)構(gòu)整合,加快農(nóng)村集體土地確權(quán)登記步伐以及實(shí)現(xiàn)不動(dòng)產(chǎn)登記檔案集約化管理,以推進(jìn)不動(dòng)產(chǎn)統(tǒng)一登記體系建設(shè),為我國公民提供一個(gè)安全、自由的交易平臺(tái)。
[Abstract]:Real estate, as a thing that everyone will use, is not only the object that we can "see and feel", but also the real estate power which is closely related to our interests. With the deepening of China's marketization, more and more things are put into circulation to realize commercialization. Because the relevant laws and regulations of our country are not perfect, it brings great inconvenience to the ordinary people's daily transaction. Especially the real estate transaction in our country has become an important part of the national economy. The lack of a unified real estate registration system seriously restricts the economic development of our country. Therefore, the plan of building a unified registration system of real estate has been put on the agenda by our government. However, as we have seen, the plan has been delayed for a variety of reasons. As the concrete implementers of the plan, the local government is to blame. In such a situation, systematically combing the development of Marx's land property right theory and real estate registration system in our country, And it is of great theoretical and practical significance to study the local government to promote the construction of the unified registration system of real estate. The interaction between these three factors, market and rural areas, and the promotion of the unified registration system of real estate by local governments is to understand the problems that local governments will face when they push forward this work. From the point of view of the government itself, competition for departmental interests, unreasonable setting of institutions, low enthusiasm for work, problems left over by history and inadequate management mechanisms are important reasons for hindering its work; from a market point of view, Only the speculators will cause trouble to the government; from the rural point of view, the ambiguity of collective land property rights and the unscientific way of land circulation will also bring some negative effects. Second, understand that local governments will bring a series of foreseeable benefits in advancing the work. From the point of view of the government itself, it has provided great convenience for the networking of real estate information, the collection of property taxes, and the establishment of an open and transparent civil servant property declaration system; from a market perspective, a more secure real estate trading platform, To curb the excessive rise in house prices and to find out the situation of the national property market will help to promote the benign development of our economy; from a rural perspective, it will help speed up the rural land reform and speed up the circulation of rural land. In view of the above problems, Local governments should promote the integration of real estate registration institutions, accelerate the registration of collective land rights in rural areas and realize the intensive management of real estate registration files, so as to promote the construction of the unified registration system of real estate and provide a security for Chinese citizens.
