【摘要】：本文首先從商標(biāo)淡化的基本理論出發(fā),通過列舉美國、德國和國際公約對(duì)馳名商標(biāo)淡化的立法規(guī)定,理清其判定標(biāo)準(zhǔn);分析我國的立法現(xiàn)狀和司法現(xiàn)狀,梳理出我國司法實(shí)踐過程中認(rèn)定淡化的標(biāo)準(zhǔn)。最后,總結(jié)出應(yīng)該如何對(duì)現(xiàn)有認(rèn)定標(biāo)準(zhǔn)加以完善。本文分四章,其第一章是基本理論。通過對(duì)淡化定義、行為性質(zhì)的闡釋分析,詳細(xì)地介紹了商標(biāo)淡化的基本內(nèi)涵。其次結(jié)合案例,論述了淡化的兩種表現(xiàn)形式和例外情形。最后,論述了淡化和混淆的關(guān)系。第二章是對(duì)域外法的比較研究。通過對(duì)美國、德國、國際公約在商標(biāo)淡化認(rèn)定方面的研究比較,較為詳細(xì)地分析了上述各國立法及國際公約的立法原因和立法效果,從中總結(jié)出其制度優(yōu)劣的結(jié)論性觀點(diǎn),以及對(duì)我國的某些啟示。第三章是對(duì)我國的立法現(xiàn)狀和司法現(xiàn)狀兩方面進(jìn)行梳理。立法上,基于對(duì)我國商標(biāo)法和司法解釋的研究、分析,論證了我國法律條文的規(guī)定是符合淡化理論的內(nèi)涵;司法實(shí)踐方面,通過對(duì)判決書的總結(jié),理出我國商標(biāo)淡化的三種處理方式,并以案例進(jìn)行論證分析。第四章在前文的基礎(chǔ)上,通過對(duì)域外法和我國司法實(shí)踐中做法的分析,總結(jié)出我國商標(biāo)淡化的司法判定標(biāo)準(zhǔn)及其不足之處。最后,以明確界定基本理論為基礎(chǔ),對(duì)商標(biāo)淡化的司法判定提出完善建議。
[Abstract]:Starting from the basic theory of trademark desalination, this paper clarifies the judging standards of well-known trademark desalination by enumerating the legislative provisions of the United States, Germany and international conventions, and analyzes the current legislative and judicial situation of our country. Combing out the standards of desalination in the course of judicial practice in our country. Finally, it summarizes how to perfect the existing standards. This paper is divided into four chapters, the first chapter is the basic theory. The basic connotation of trademark desalination is introduced in detail by analyzing the definition of dilution and the nature of behavior. Secondly, it discusses the two forms and exceptions of desalination. Finally, the relationship between dilution and confusion is discussed. The second chapter is the comparative study of the extraterritorial laws. Through the comparison of the research on the trademark desalination of the United States, Germany and international conventions, this paper analyzes in detail the legislative reasons and the legislative effects of the above countries' legislation and international conventions, and concludes the conclusion of the advantages and disadvantages of the system. And some enlightenment to our country. The third chapter is to comb the legislative and judicial status quo in China. In legislation, based on the study of trademark law and judicial interpretation of our country, it is proved that the provisions of Chinese legal provisions are in accordance with the connotation of desalination theory. In this paper, three ways of dealing with trademark dilution in China are discussed and analyzed by case study. The fourth chapter, on the basis of the above, through the analysis of the extraterritorial law and the judicial practice of our country, summarizes the judicial judgment standard and its deficiency of trademark desalination in our country. Finally, on the basis of defining the basic theory clearly, the author puts forward some suggestions on the judicial judgment of trademark dilution.
