【摘要】："轉(zhuǎn)換性使用"理論是美國(guó)法官在司法實(shí)踐中創(chuàng)立并用于判斷合理使用的一個(gè)要素。隨著相關(guān)司法判例的累積,各類新型使用行為層出不窮,"轉(zhuǎn)換性使用"在合理使用中的地位日益突出,其內(nèi)涵也不斷拓展。從當(dāng)前的司法實(shí)踐來看,"轉(zhuǎn)換性使用"在合理使用中的重要性已逐漸超越"對(duì)作品潛在市場(chǎng)的影響"要素,成為合理使用判斷的主導(dǎo)要素。法院對(duì)"轉(zhuǎn)換性使用"的界定應(yīng)以相關(guān)作品領(lǐng)域的"普通理性公眾"為標(biāo)準(zhǔn),判斷重心應(yīng)從"內(nèi)容性轉(zhuǎn)換"向"目的性轉(zhuǎn)換"轉(zhuǎn)移。我國(guó)的司法實(shí)務(wù)也突顯了對(duì)"轉(zhuǎn)換性使用"理論的需求,然而,法院突破現(xiàn)行著作權(quán)法對(duì)限制與例外的封閉式規(guī)定以適用"轉(zhuǎn)換性適用"理論僅是權(quán)益之計(jì),最佳做法是值此著作權(quán)修法之際,對(duì)"轉(zhuǎn)換性使用"理論進(jìn)行本土化改造。
[Abstract]:The theory of "transformative use" is an important element that American judges have established in judicial practice and used to judge reasonable use. With the accumulation of relevant judicial precedents, various kinds of new use behaviors emerge endlessly. The status of "transformational use" in rational use is becoming increasingly prominent, and its connotation is constantly expanding. From the current judicial practice, the importance of "transformational use" in rational use has gradually exceeded the "influence on the potential market of works" and become the dominant factor of rational use judgment. The court's definition of "transformative use" should be based on the standard of "ordinary rational public" in the field of relevant works, and the focus of judgment should be shifted from "content conversion" to "purposeful transformation". The judicial practice of our country also highlights the demand for the theory of "transformational use". However, it is only a measure of rights and interests for the courts to break through the closed provisions of the current copyright law on restrictions and exceptions to apply the theory of "transformational application". The best practice is to localize the theory of "transformative use" at the time of copyright amendment.
