【摘要】：伴隨著互聯(lián)網(wǎng)與信息技術(shù)的飛速發(fā)展,人與人之間的交流方式逐漸從現(xiàn)實世界向虛擬世界過渡,網(wǎng)絡(luò)發(fā)展速度如此之快的同時給全世界帶來了巨大的影響,由此也產(chǎn)生了諸多的新鮮事物,例如,在網(wǎng)絡(luò)游戲過程中產(chǎn)生的各種裝備、網(wǎng)店的信譽度,以及微信里的照片、視頻、音頻等,這些與我們在現(xiàn)實生活中看到的實物有著本質(zhì)上的差別：它們看不到、摸不著,僅以電子數(shù)據(jù)的方式存在于互聯(lián)網(wǎng)這一龐大的載體中,我們稱之為“互聯(lián)網(wǎng)數(shù)字財產(chǎn)”。現(xiàn)代信息技術(shù)發(fā)展如此之快,導(dǎo)致互聯(lián)網(wǎng)數(shù)字財產(chǎn)的存在范圍呈擴大趨勢,同時種類不斷增加,方式不斷創(chuàng)新,所以在互聯(lián)網(wǎng)數(shù)字財產(chǎn)領(lǐng)域,各種法律問題層出不窮：互聯(lián)網(wǎng)數(shù)字財產(chǎn)是否屬于財產(chǎn)范疇?所有人去世之后,互聯(lián)網(wǎng)數(shù)字財產(chǎn)是否可以被繼承?互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承的方式和范圍又是怎樣的?繼承過程中又會帶來怎樣的問題?本文首先對互聯(lián)網(wǎng)數(shù)字財產(chǎn)的概念、特征及法律屬性進行了界定,為法律承認(rèn)互聯(lián)網(wǎng)數(shù)字財產(chǎn)的繼承奠定了基礎(chǔ)；接下來分析互聯(lián)網(wǎng)數(shù)字財產(chǎn)的可繼承性及各種法律問題,認(rèn)為互聯(lián)網(wǎng)數(shù)字財產(chǎn)同現(xiàn)實財產(chǎn)一樣是可以被繼承的；并思考了互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承過程中產(chǎn)生的侵權(quán)問題、違約問題及其他領(lǐng)域的問題并提出了解決方法以期待對相關(guān)的司法實務(wù)有所裨益。本文正文部分主要分為五個部分：第一部分列舉了網(wǎng)絡(luò)環(huán)境中發(fā)生的大量互聯(lián)網(wǎng)數(shù)字財產(chǎn)案例,引出為了解決此類網(wǎng)絡(luò)環(huán)境糾紛,可否將互聯(lián)網(wǎng)數(shù)字財產(chǎn)納入可繼承范圍的問題。第二部分主要內(nèi)容是互聯(lián)網(wǎng)數(shù)字財產(chǎn)的基本理論綜述：首先明確了互聯(lián)網(wǎng)數(shù)字財產(chǎn)的概念及分類,然后對互聯(lián)網(wǎng)數(shù)字財產(chǎn)的可繼承性進行論證,最后論述互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承制度的價值與意義。第三部分主要內(nèi)容是國內(nèi)外互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承法律依據(jù)探析。通過對世界各國各地區(qū)有關(guān)互聯(lián)網(wǎng)數(shù)字財產(chǎn)方面的立法及判例進行分析,它們是否可以為互聯(lián)網(wǎng)數(shù)字財產(chǎn)的繼承制度提供法律依據(jù),最后總結(jié)出可以學(xué)習(xí)和借鑒的內(nèi)容,為我國相關(guān)制度的完善提供學(xué)習(xí)標(biāo)準(zhǔn)。第四部分主要內(nèi)容是互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承前后出現(xiàn)的一系列問題,首先是互聯(lián)網(wǎng)數(shù)字財產(chǎn)法律屬性和權(quán)利歸屬問題,為互聯(lián)網(wǎng)數(shù)字財產(chǎn)的繼承提供理論支持,然后分析互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承是否會侵犯用戶隱私權(quán)、是否與網(wǎng)絡(luò)用戶協(xié)議想矛盾以及繼承過程中的價值評估等問題。第五部分主要根據(jù)上面的問題提供解決思路,怎樣能在現(xiàn)有法律范圍內(nèi)有效的解決出現(xiàn)的問題,首先可以嘗試完善相關(guān)法律,其次可以考慮將互聯(lián)網(wǎng)數(shù)字財產(chǎn)納入遺產(chǎn)繼承的范圍,還可以建立互聯(lián)網(wǎng)數(shù)字財產(chǎn)價值評估的制度,在法律及實踐方面對互聯(lián)網(wǎng)數(shù)字財產(chǎn)繼承制度進行完善。
[Abstract]:With the rapid development of the Internet and information technology, the way of communication between people gradually from the real world to the virtual world, the rapid development of the network has brought a tremendous impact on the world at the same time. As a result, many new things have emerged, such as the various equipment generated in the course of online games, the reputation of the online store, and the photos, videos, audio in WeChat, etc. These are essentially different from the physical objects we see in real life: they can't see, touch, and exist only in the form of electronic data in the vast carrier of the Internet, which we call "Internet digital property". The rapid development of modern information technology has led to the expansion of the scope of digital property on the Internet. At the same time, the variety is constantly increasing and the way of innovation is constantly innovating, so in the field of digital property on the Internet, A variety of legal issues emerge: Internet digital property is a property category? Can Internet Digital property be inherited after everyone dies? What is the way and scope of Internet digital property inheritance? What problems will arise in the process of inheritance? This paper first defines the concept, characteristics and legal attributes of Internet digital property, which lays a foundation for the legal recognition of the inheritance of Internet digital property, and then analyzes the inheritance of Internet digital property and various legal issues. Holding that Internet digital property can be inherited as real property, and thinking about the infringement in the process of Internet digital property inheritance, The problem of breach of contract and other problems are put forward in order to be helpful to the relevant judicial practice. The main body of this paper is divided into five parts: the first part lists a large number of Internet digital property cases in the network environment, leading to the settlement of such network environment disputes. Whether the Internet digital property can be included in the scope of inheritance. The second part is a summary of the basic theory of Internet digital property: firstly, it clarifies the concept and classification of Internet digital property, and then demonstrates the inheritance of Internet digital property. Finally, the paper discusses the value and significance of Internet digital property inheritance system. The third part of the main content is the domestic and foreign Internet digital property inheritance legal basis analysis. Through the analysis of the legislation and precedents about the Internet digital property in various countries and regions of the world, whether they can provide the legal basis for the succession system of the Internet digital property, and finally summarize the contents that can be learned and used for reference. For the improvement of relevant systems in China to provide learning standards. The fourth part of the main content is a series of problems before and after the succession of Internet digital property, the first is the legal attributes of Internet digital property and the ownership of rights, which provides theoretical support for the succession of Internet digital property. Then it analyzes whether the succession of Internet digital property will infringe upon the user's privacy, whether it conflicts with the network user's agreement and the value evaluation in the process of inheritance. The fifth part mainly according to the above question provides the solution train of thought, how can the existing law effectively solve the problem which appears, first may try to consummate the related law, Secondly, we can consider bringing Internet digital property into the scope of inheritance, and we can also establish the system of evaluating the value of Internet digital property, and perfect the system of Internet digital property inheritance in law and practice.
