【摘要】：伴隨著經(jīng)濟(jì)全球化,科技發(fā)展突飛猛進(jìn),因?qū)＠謾?quán)產(chǎn)生的法律糾紛如雨后春筍,禁止反悔原則作為專利法中的一項(xiàng)重要原則,在認(rèn)定專利侵權(quán)中發(fā)揮著越來(lái)越關(guān)鍵的作用。針對(duì)這一司法實(shí)踐現(xiàn)象,本文從最新的案例入手,對(duì)禁止反悔原則在司法審判中的適用界限進(jìn)行了闡述。論文的主體結(jié)構(gòu)有四部分。第一部分言簡(jiǎn)意賅的介紹禁止反悔原則的概念、起源與發(fā)展。第二部分通過(guò)對(duì)“愛國(guó)者電子案”和“中譽(yù)電子案”的分析,引出禁止反悔原則在個(gè)案件中的不同適用情形。從而分析禁止反悔原則的不同適用情形。第三部分先是簡(jiǎn)單的說(shuō)明了禁止反悔原則與等同原則的關(guān)系,其后通過(guò)“白樺林”案引出相同侵權(quán)與禁止反悔原則的關(guān)系。第四部分對(duì)禁止反悔原則的主體資格進(jìn)行分析。
[Abstract]:With the economic globalization and the rapid development of science and technology, legal disputes arising from patent infringement are springing up. As an important principle in patent law, the estoppel principle plays a more and more crucial role in the identification of patent infringement. In view of this judicial practice phenomenon, this article starts with the latest case, and expounds the applicable limits of estoppel principle in judicial trial. The main structure of the thesis has four parts. The first part briefly introduces the concept, origin and development of estoppel principle. In the second part, through the analysis of "Patriot Electronic case" and "Zhongyu Electronic case", the different application of estoppel principle in each case is introduced. In order to analyze the different application of estoppel principle. The third part briefly explains the relationship between estoppel principle and equivalent principle, and then leads to the relationship between the same tort and estoppel principle through the case of "Birch Forest". The fourth part analyzes the subject qualification of estoppel principle.
