【摘要】：在網(wǎng)絡(luò)游戲自主開發(fā)中,游戲規(guī)則的創(chuàng)作設(shè)計(jì)凝聚了大量智力勞動(dòng),是游戲的核心構(gòu)成元素,應(yīng)當(dāng)且已經(jīng)受到著作權(quán)保護(hù)。以"思想/表達(dá)"二分法分析,游戲具體規(guī)則中的獨(dú)創(chuàng)性表達(dá)落入了著作權(quán)保護(hù)范圍。在我國著作權(quán)法框架之下,將游戲整體畫面認(rèn)定為類電影作品能夠間接保護(hù)游戲規(guī)則,但僅為權(quán)宜之計(jì)。隨著技術(shù)和產(chǎn)業(yè)發(fā)展,對游戲規(guī)則的直接保護(hù)甚至對游戲作品性質(zhì)的重新審視將成為著作權(quán)法和司法實(shí)踐不得不面對的問題。
[Abstract]:In the independent development of online games, the creative design of game rules condenses a lot of intellectual labor, which is the core element of the game and should and has been protected by copyright. According to the dichotomy of "thought / expression", the original expression in the specific rules of the game falls into the scope of copyright protection. Under the frame of copyright law of our country, the whole picture of the game can indirectly protect the rules of the game, but it is only an expedient measure. With the development of technology and industry, the direct protection of the rules of the game and even the re-examination of the nature of the game works will become a problem that copyright law and judicial practice have to face.
