開放許可:制度優(yōu)勢(shì)與法律構(gòu)造

【摘要】:版權(quán)法中的開放許可是權(quán)利人自愿放棄部分權(quán)利,允許公眾在一定范圍內(nèi),遵循相關(guān)規(guī)則自由使用作品的許可模式。不同于產(chǎn)權(quán)化路徑下的傳統(tǒng)"先授權(quán)后使用"的版權(quán)許可模式,開放許可以"部分所有權(quán)保留"的模式允許公眾在一定范圍內(nèi)自由使用作品。毋庸置疑,開放許可能夠促進(jìn)作品的有效利用與傳播,其共享理念和運(yùn)作模式與互聯(lián)網(wǎng)產(chǎn)業(yè)的利益訴求高度契合。然而,長(zhǎng)久以來,開放許可并未被真正納入到版權(quán)法的調(diào)整范圍。開放許可的制度激勵(lì)不足和相關(guān)規(guī)范的缺失,使得其優(yōu)勢(shì)難以真正發(fā)揮。鑒于此,版權(quán)立法有必要關(guān)涉開放許可,利用公共政策引導(dǎo)和推動(dòng)開放許可的實(shí)施,并完善開放許可協(xié)議的效力規(guī)則與救濟(jì)機(jī)制。惟其如此,才能實(shí)現(xiàn)開放許可運(yùn)動(dòng)的初衷。
[Abstract]:The open license in copyright law is the license mode that the right holder voluntarily relinquishes part of the right and allows the public to use the work freely within a certain range of rules. Different from the traditional copyright licensing mode of "first license and then use" under the path of property right, the open license allows the public to use the work freely within a certain range by the mode of "partial ownership retention". There is no doubt that open licensing can promote the effective use and dissemination of works, and its shared concept and operation mode are highly consistent with the interests of the Internet industry. However, for a long time, open licensing has not really been incorporated into the scope of copyright law. The lack of institutional incentives and the lack of relevant norms of open licensing make it difficult to give full play to its advantages. In view of this, it is necessary for copyright legislation to involve open license, to use public policy to guide and promote the implementation of open license, and to perfect the effective rules and relief mechanism of open license agreement. Only in this way, can realize the original intention of the open license movement.
