【摘要】：3D打印開(kāi)放創(chuàng)新是以產(chǎn)品設(shè)計(jì)圖作為核心要素發(fā)展起來(lái)的,具有創(chuàng)新主體社會(huì)化和行為民主化相互促進(jìn)的特點(diǎn),并且形成了產(chǎn)品發(fā)明成果集成化與權(quán)利碎片化的耦合發(fā)展。相對(duì)于3D打印創(chuàng)新活動(dòng)的特點(diǎn),現(xiàn)行專(zhuān)利制度存在專(zhuān)利授權(quán)的門(mén)檻較高、保護(hù)制度過(guò)于僵化,以及權(quán)利人實(shí)施義務(wù)缺失等問(wèn)題。對(duì)此,我國(guó)應(yīng)進(jìn)行專(zhuān)利制度的變革,實(shí)現(xiàn)專(zhuān)利授權(quán)機(jī)制的靈活化,同時(shí)強(qiáng)化專(zhuān)利權(quán)人獲得保護(hù)后應(yīng)承擔(dān)的義務(wù),并在新的專(zhuān)利法框架下實(shí)現(xiàn)利益平衡,以促進(jìn)3D打印產(chǎn)業(yè)的有序發(fā)展。
[Abstract]:The open innovation of 3D printing is developed with product design drawing as the core element. It has the characteristics of socialization of innovation subject and democratization of behavior, and has formed the coupling development of integration of product invention achievements and fragmentation of rights. Compared with the characteristics of 3D printing innovation, the current patent system has some problems, such as high threshold of patent authorization, too rigid protection system, and lack of implementation obligation of the right holder. In view of this, our country should reform the patent system, realize the flexibility of patent authorization mechanism, strengthen the obligation of the patentee after obtaining the protection, and realize the benefit balance under the new patent law frame. In order to promote the orderly development of 3D printing industry.
