【摘要】：當前,嚴格知識產(chǎn)權(quán)保護成為國際法律、經(jīng)濟、政治的大勢所趨。將技術(shù)進步作為直接和間接中間變量,梳理嚴格知識產(chǎn)權(quán)保護作用機理,回顧以往文獻中關(guān)于嚴格知識產(chǎn)權(quán)保護對技術(shù)轉(zhuǎn)移和創(chuàng)新、FDI、國際貿(mào)易、社會福利、收入分配及經(jīng)濟增長的效用爭論,從研究框架、研究模型、研究視角3個方面解釋該爭論。分析影響知識產(chǎn)權(quán)制度效用的國際、國內(nèi)因素,提出最大化知識產(chǎn)權(quán)制度效用的生態(tài)演化系統(tǒng)構(gòu)想。從研究內(nèi)容細化、研究視角拓展、研究模型深化、研究方法多樣化4個方面對嚴格知識產(chǎn)權(quán)保護效用及作用機理的未來研究作出展望。
[Abstract]:At present, strict protection of intellectual property rights has become the general trend of international law, economy and politics. Taking technological progress as a direct and indirect intermediate variable, combing the mechanism of strict intellectual property protection, reviewing the previous literature on strict intellectual property protection for technology transfer and innovation, international trade, social welfare, The debate on the utility of income distribution and economic growth is explained from three aspects: the research framework, the research model and the research perspective. This paper analyzes the international and domestic factors that affect the utility of intellectual property system, and puts forward a systematic conception of ecological evolution to maximize the utility of intellectual property system. The future research on the effectiveness and mechanism of strict intellectual property protection is prospected from four aspects: the refinement of the research content, the expansion of the research perspective, the deepening of the research model and the diversification of the research methods.
