【摘要】：兒童的健康權(quán)利要得到保障首要在于立法,要將兒童的健康權(quán)利通過法律的形式將其規(guī)定起來并給予保護(hù),這是對(duì)兒童健康權(quán)最重要的保障。我國(guó)憲法和法律都對(duì)兒童健康權(quán)的保護(hù)給予規(guī)定,但由于兒童健康權(quán)是健康權(quán)中一項(xiàng)特殊的權(quán)利,法規(guī)不完善,保護(hù)難度比較大,從而導(dǎo)致我國(guó)對(duì)兒童健康權(quán)的保護(hù)仍然存在很多缺陷,亟需完善。本文試從兒童健康權(quán)的立法狀況進(jìn)行剖析,希望為我國(guó)兒童健康權(quán)的發(fā)展和保障有一定的借鑒意義。
[Abstract]:The protection of children's right to health mainly lies in legislation. It is the most important guarantee for children's right to health that children's right to health should be stipulated and protected by law. Both the constitution and the law of our country provide for the protection of children's right to health. However, since the right of children's right to health is a special right in the right to health, the laws and regulations are not perfect, so it is difficult to protect children's right to health. As a result, there are still many defects in the protection of children's right to health in our country. This paper tries to analyze the legislative situation of children's right to health, hoping that it can be used for reference for the development and protection of children's right to health in our country.
