【摘要】:在網(wǎng)絡(luò)購物盛行的今天,針對網(wǎng)絡(luò)購物所出現(xiàn)的新情況與新問題,現(xiàn)行《消費者權(quán)益保護法》(以下簡稱《消法》)規(guī)定了網(wǎng)絡(luò)購物“后悔權(quán)”制度,然而,該制度的實施需要一系列配套制度,尤其是在“后悔權(quán)”的行使等諸多方面還存在許多爭議,例如:對濫用“后悔權(quán)”的行為如何界定、限制,處罰的范圍如何確定,在找不到賣家的情況下,消費者的權(quán)益如何維護、責(zé)任如何認定、退貨運費由誰承擔(dān)等大量民事法律問題,成為當(dāng)下“網(wǎng)購”糾紛主要組成部分。所謂“后悔權(quán)”,就是法律給予消費者的一種權(quán)利,指消費者在購買商品后,如果對自己的消費行為“后悔”了,可以在法律規(guī)定的合理時間內(nèi),根據(jù)消費者的想法,將其購買的商品退給銷售者,并且不需要說明理由,也不需要支付任何費用!昂蠡跈(quán)”設(shè)立的初衷,是為消費者營造一個“冷靜期”,即消費者可以在購買商品后的一段時間內(nèi)對自己的消費行為做出更為理性的判斷,并有權(quán)利要求退貨的行為,以此來保護消費者的合法權(quán)益。本文試圖從《消法》等相關(guān)法律的規(guī)定入手,結(jié)合實例,對“網(wǎng)購”中出現(xiàn)的上述問題通過法理分析,并在此基礎(chǔ)上深入探討“網(wǎng)購”下“后悔權(quán)”法律問題的實質(zhì),提出自己對網(wǎng)購“后悔權(quán)”相關(guān)問題在法律層面的認識,例如:“后悔權(quán)”的概念、性質(zhì)等;對網(wǎng)購“后悔權(quán)”的具體規(guī)制,例如:針對消費者濫用“后悔權(quán)”的一些法律規(guī)制等;對于該制度的完善等相關(guān)問題,例如:從哪些方面進行立法規(guī)范,怎樣建立“后悔權(quán)”制度的保障機制等,提出自己的一些建議。
[Abstract]:With the popularity of online shopping, the current "Consumer Rights and interests Protection Law" (hereinafter referred to as "Consumer Law") prescribes the "regret right" system of online shopping, aiming at the new situation and new problems of online shopping.The implementation of the system requires a series of supporting systems, especially in the exercise of the "right of regret" and many other aspects of controversy, such as: abuse of "regret rights" how to define, limit, how to determine the scope of punishment.In the case of unable to find the seller, how to safeguard the rights and interests of the consumer, how to determine the responsibility, and who should bear the return freight have become the main part of the dispute of "online purchase".The so-called "right of regret" is a right given by law to consumers. It means that if consumers "regret" their own consumer behavior after buying a commodity, they can, within a reasonable period of time prescribed by law, according to the consumer's opinion,The goods purchased are returned to the seller without justification or payment.The original intention of the "right of regret" is to create a "cooling-off period" for consumers, that is, consumers can make a more rational judgment on their own consumption behavior and have the right to demand the return of goods within a period of time after purchasing the goods.In order to protect the legitimate rights and interests of consumers.This article attempts to start with the provisions of the relevant laws, such as the "law of elimination", and combines with an example to analyze the above problems in "online shopping" through legal theory, and on this basis, deeply discusses the essence of the legal problems of "the right of regret" under "online shopping".The author puts forward his own understanding of the issues related to the "right of regret" of online shopping, such as the concept and nature of "right of regret", the specific regulation of "right of regret" of online purchase, and so on.For example, some legal regulations on the abuse of "right of regret" by consumers, and so on, as well as the improvement of the system, such as: from what aspects to regulate the legislation, how to establish the "right of regret" system protection mechanism, etc.Put forward some of your own suggestions.
