【摘要】：生物技術(shù)產(chǎn)業(yè)已然成為世界經(jīng)濟(jì)增長(zhǎng)的新引擎,但目前生物技術(shù)領(lǐng)域的“專利叢林”現(xiàn)象嚴(yán)重阻礙該領(lǐng)域的進(jìn)一步發(fā)展。為了應(yīng)對(duì)專利叢林的問(wèn)題,國(guó)際法學(xué)界相繼提出構(gòu)建生物技術(shù)專利池。一方面構(gòu)建專利池在理論上將有效減少生物技術(shù)領(lǐng)域的“專利叢林”、降低許可交易成本,分散風(fēng)險(xiǎn)、促進(jìn)生物技術(shù)領(lǐng)域的自主創(chuàng)新,在實(shí)踐中也促進(jìn)了相關(guān)產(chǎn)業(yè)的發(fā)展。另一方面構(gòu)建專利池可能導(dǎo)致壟斷、阻礙市場(chǎng)的正當(dāng)競(jìng)爭(zhēng)、企業(yè)的自主創(chuàng)新、保護(hù)無(wú)效專利、增加企業(yè)成本等問(wèn)題,在實(shí)踐中專利池也導(dǎo)致了市場(chǎng)的壟斷。國(guó)際社會(huì)為了解決生物技術(shù)領(lǐng)域“專利叢林”的問(wèn)題,已形成了包括眼科激光手術(shù)專利池、黃金大米專利池等在內(nèi)的數(shù)個(gè)專利池,可以劃分為商業(yè)型生物技術(shù)專利池和公益性生物技術(shù)專利池。它們?cè)趯＠氐倪\(yùn)行機(jī)制、入池專利權(quán)的寬度、管理機(jī)構(gòu)等方面做了積極的探索。構(gòu)建專利池在全球愈演愈烈,我國(guó)在借鑒國(guó)外有益經(jīng)驗(yàn)的基礎(chǔ)上,提出構(gòu)建生物技術(shù)專利池的具體程序,包括制定技術(shù)標(biāo)準(zhǔn)、設(shè)立許可模式、簽訂專利池協(xié)議等。同時(shí)也分別從《專利法》、《反壟斷法》完善法律規(guī)制,為專利池的構(gòu)建奠定良好的法律基礎(chǔ)。
[Abstract]:The biotechnology industry has become a new engine of world economic growth, but the "patent jungle" phenomenon in the field of biotechnology seriously hinders the further development of this field.In order to deal with the problem of patent jungle, international legal circles have put forward the construction of biotechnology patent pool.On the one hand, the construction of patent pool in theory will effectively reduce the "patent jungle" in the field of biotechnology, reduce the cost of licensing transactions, disperse risks, promote independent innovation in the field of biotechnology, and promote the development of related industries in practice.On the other hand, the construction of patent pool may lead to monopoly, hinder fair competition of market, independent innovation of enterprise, protect invalid patent, increase enterprise cost and so on. In practice, patent pool also leads to monopoly of market.In order to solve the problem of the "patent jungle" in the field of biotechnology, the international community has formed several patent pools, including the patent pool for ophthalmic laser surgery and the patent pool for golden rice.It can be divided into commercial biotechnology patent pool and public welfare biotechnology patent pool.They have made active exploration in the operation mechanism of patent pool, the width of patent right of entering pool, the management organization and so on.The construction of patent pool is becoming more and more serious all over the world. On the basis of drawing on the beneficial experience of foreign countries, our country puts forward the concrete procedure of constructing the patent pool of biotechnology, including the establishment of technical standard, the establishment of licensing mode, the signing of patent pool agreement, and so on.At the same time, the patent law and the anti-monopoly law respectively improve the legal regulation, and lay a good legal foundation for the construction of patent pool.
