【摘要】：作為一種從域外移植而來(lái)的制度,專利制度經(jīng)過(guò)30余年的運(yùn)行、磨合及完善,其中國(guó)化特征日益彰顯�？疾鞂＠贫戎袊�(guó)化路徑應(yīng)當(dāng)從實(shí)踐和文化兩個(gè)維度進(jìn)行:專利制度中國(guó)化在有效回應(yīng)中國(guó)經(jīng)濟(jì)社會(huì)發(fā)展的現(xiàn)實(shí)需求基礎(chǔ)上,構(gòu)建了具有中國(guó)特色的專利戰(zhàn)略和專利行政保護(hù)制度;與此同時(shí),專利制度中國(guó)化還應(yīng)當(dāng)實(shí)現(xiàn)與傳統(tǒng)文化精髓的無(wú)障礙銜接,將創(chuàng)新文化、契約文化和誠(chéng)信文化內(nèi)化為具體的法律制度。由此,專利制度在與中國(guó)國(guó)史民情的融合過(guò)程中形成專利制度中國(guó)道路的"理論版"、發(fā)展中國(guó)家專利制度的"示范版"和國(guó)際專利話語(yǔ)權(quán)體系的"中國(guó)版"。
[Abstract]:As a system transplanted from abroad, the patent system has been running for more than 30 years, and its Chinese characteristics are becoming more and more obvious.The investigation of patent system in China should be carried out from the perspectives of practice and culture: on the basis of responding effectively to the realistic demands of China's economic and social development, the patent system should be Sinicized.The patent strategy and patent administrative protection system with Chinese characteristics have been constructed, and at the same time, the patent system in China should be connected with the essence of traditional culture without hindrance, and the innovation culture should be realized.The contract culture and the good faith culture internalize into the concrete legal system.Thus, the patent system forms the "theoretical version" of the patent system in China, the "model edition" of the patent system in developing countries and the "Chinese version" of the international patent discourse system in the process of merging the patent system with the national history of China.
