【摘要】：研究隱私權,不得不提及的人物是路易斯·D·布蘭代斯(Louis D. Brandeis)。他與塞謬爾·D·沃倫(Samuel D. Warren)合著的《隱私權》一文長期占據Heinonline引用率排行榜榜首,國內外學界主流觀點認為該文首次闡發(fā)了隱私權理論。而他在奧姆斯特德訴美國案(Olmstead v. United States)中的異議意見聞名于世,亦被國內外研究隱私權理論的學者不斷引用。他在吉爾伯特訴明尼蘇達州案(Gilbert v. Minnesotae)中的異議意見、帕克公司訴猶他州案(Packer Corporation v.Utah)中所著的法庭意見中也包含隱私權思想,影響深遠�！扒謾嚯[私權——憲法隱私權”這一分析工具易令人只關注到侵權主體的區(qū)別,更為恰當?shù)姆治龉ぞ呤悄釥枴だ聿榈?Neil M. Richards)教授所闡釋的侵權隱私權、智識隱私權二分法。布蘭代斯在其一生中,關于隱私權與言論自由關系的思想不斷發(fā)展變化,陷入自己在《隱私權》一文中所宣稱的侵權理論的深刻矛盾之中。布蘭代斯隱私權思想經歷了由侵權隱私權變?yōu)橹亲R隱私權的轉向。
[Abstract]:The person to be mentioned in the study of privacy is Louis D. Brandeisan.His paper "Privacy", co-written by Samuel D. Warren and Samuel D. Warren, has long occupied the top of the list of Heinonline citations. The mainstream view at home and abroad holds that this article has for the first time elucidated the theory of privacy.His dissent in Olmstead v. United States is well known and cited by scholars studying privacy theories at home and abroad.His dissent in Gilbert v. Minnesotae in Gilbert v. Minnesota and Packer Corporation v. Utah in Parker v. Utah also contained the idea of privacy.The analysis tool of "tort privacy-constitutional privacy" makes people pay attention only to the difference of the subject of infringement. The more appropriate analysis tool is the dichotomy of intellectual privacy and infringing privacy explained by Professor Neil Richard M. Richard.In his life, Brandis' thoughts on the relationship between privacy and freedom of speech have been constantly changing, falling into the profound contradiction of tort theory claimed by him in "Privacy".The thought of Brandeis' right of privacy has changed from infringing right of privacy to intellectual right of privacy.
