【摘要】：在互聯(lián)網(wǎng)絡(luò)和即時通訊工具的雙重作用下,涉及網(wǎng)絡(luò)服務的知識產(chǎn)權(quán)問題受到了全社會的普遍關(guān)注。其中,電影網(wǎng)絡(luò)化傳播在為其帶來更多收益的同時,卻因著作權(quán)保護乏力使電影作品的權(quán)益收益亂象叢生,為電影事業(yè)的健康發(fā)展埋下隱患,也在很大程度上擾亂了文化產(chǎn)業(yè)和文化市場的秩序。文章以此為視角,針對網(wǎng)絡(luò)環(huán)境下電影著作權(quán)的特征、侵權(quán)責任認定以及保護措施等問題展開討論,希望借此為電影事業(yè)健康發(fā)展提供有價值的信息。
[Abstract]:Under the dual action of the Internet and instant communication tools, the intellectual property rights (IPR) related to network services have received widespread attention in the whole society.Among them, the film network communication brings more benefits to it, but because of the lack of copyright protection, the rights and interests of the film works are in chaos, which is the hidden danger for the healthy development of the film industry.It also disturbs the order of cultural industry and cultural market to a great extent.From this angle of view, this paper discusses the characteristics of film copyright, the identification of tort liability and the protection measures under the network environment, hoping to provide valuable information for the healthy development of the film industry.
