【摘要】：近兩年,某軟件著作權(quán)人利用TELNET協(xié)議遠程登錄被控侵權(quán)人的網(wǎng)站服務器,并將帶有其軟件名稱的反饋信息經(jīng)過公證,作為侵權(quán)證據(jù),訴請法院判定軟件著作權(quán)侵權(quán)成立。各地法院對此莫衷一是。本文認為,關于TELNET取證在計算機軟件著作權(quán)侵權(quán)判定中的作用,需明晰舉證責任完成與否,結(jié)合考慮軟件著作權(quán)侵權(quán)判定要素,在綜合分析經(jīng)公證后TELNET取證所獲電子數(shù)據(jù)的證據(jù)能力與證據(jù)效力后,方能得出較為合理的結(jié)論。TELNET取證所獲電子數(shù)據(jù)經(jīng)公證后,可作為申請法院進行證據(jù)保全的證據(jù)材料,但尚不足以作為認定存在侵權(quán)行為的主要證據(jù)。軟件著作權(quán)侵權(quán)判定仍應恪守"接觸+實質(zhì)性相似"的判斷規(guī)則。
[Abstract]:In the last two years, the software copyright owner remotely logs on the website server of the alleged infringer by using TELNET protocol, and notarizes the feedback information with the name of the software, and as the infringement evidence, appeals to the court to decide the software copyright infringement is established.Courts all over the place disagree on this.This paper holds that the role of TELNET evidence in the judgment of computer software copyright infringement should be made clear whether the burden of proof is completed or not, and the elements of software copyright infringement judgment should be considered.Only after the comprehensive analysis of the evidential ability and validity of the electronic data obtained by TELNET after notarization, can we draw a more reasonable conclusion. After the electronic data obtained by TELNET are notarized, they can be used as evidence materials for the preservation of evidence in the application court.However, it is not enough to be the main evidence of the existence of tort.The judgment of software copyright infringement should still abide by the rule of "contact substantial similarity".
