【摘要】:假冒偽劣“專營、專賣”商品案件層出不窮,但實踐中往往是對生產(chǎn)、銷售假冒食鹽、煙草的當(dāng)事人刑事、行政的處罰,很少看到專營、專賣商品商標(biāo)持有人對侵犯其商品商標(biāo)權(quán)的維護(hù)。假冒偽劣商品被稱之為世界上除毒品外的第二大危害,我國更成為假冒偽劣商品的第一大生產(chǎn)國。作為國家專營、專賣的食鹽、煙草等特殊商品在假冒偽劣“專營、專賣“產(chǎn)品給人們經(jīng)濟(jì)、健康帶來影響的同時,更影響到專營、專賣企業(yè)商品商標(biāo)權(quán)益的健康發(fā)展。專營、專賣商品具有一定的特殊性,對其商標(biāo)的保護(hù),不僅使企業(yè)商標(biāo)形象不受損害,更是保護(hù)消費(fèi)者對專營、專賣商品的信任。國家對專營、專賣商品有特別的法律和法規(guī)規(guī)章來保護(hù)。作為企業(yè)自身也有維護(hù)其商標(biāo)合法權(quán)益的責(zé)任,本文試圖通過研究提出企業(yè)應(yīng)對假冒偽劣商品的商標(biāo)保護(hù)措施。本文共分為五個部分:第一章假冒偽劣產(chǎn)品對專營、專賣商品的社會危害性。專營、專賣商品具有特殊性。假冒偽劣產(chǎn)品會給國家經(jīng)濟(jì)造成損失,影響消費(fèi)者身體健康,使消費(fèi)者對國家專營、專賣制度產(chǎn)生疑惑;第二章假冒偽劣產(chǎn)品對專營、專賣商品商標(biāo)專有權(quán)的破壞及侵犯專營、專賣商品商標(biāo)權(quán)的表現(xiàn)形式;第三章假冒偽劣產(chǎn)品侵權(quán)行為的歸責(zé),包括商標(biāo)侵權(quán)的舉證制度、舉證責(zé)任分配和侵犯專營、專賣商品商標(biāo)權(quán)的舉證責(zé)任分析;第四章企業(yè)應(yīng)對假冒偽劣商品侵權(quán)的措施建設(shè),包括我國企業(yè)在各個階段的商標(biāo)保護(hù)措施和美國等發(fā)達(dá)國家企業(yè)的商標(biāo)保護(hù)經(jīng)驗。
[Abstract]:Fake and shoddy "exclusive, exclusive" commodity cases emerge in endlessly, but in practice, criminal and administrative penalties are often imposed on the parties involved in the production and sale of counterfeit salt and tobacco.The protection of trademark holders of monopolized goods against infringement of their trademark rights.Counterfeit and inferior commodities are called the second most harmful in the world besides drugs, and our country has become the largest producer of fake and inferior goods.As the national monopoly, monopoly salt, tobacco and other special commodities in fake and inferior "franchise, monopoly" products to people's economy, health impact, but also affect the franchise, monopoly enterprise trademark rights and interests of the healthy development.The protection of the trademark not only protects the image of the enterprise trademark, but also protects the trust of the consumer to the exclusive and exclusive goods.The state has special laws and regulations to protect exclusive and exclusive commodities.As the enterprise itself also has the responsibility to safeguard its trademark legitimate rights and interests, this paper tries to put forward the trademark protection measures for enterprises to deal with fake and inferior goods through research.This paper is divided into five parts: the first chapter is the social harmfulness of fake and inferior products.Franchise, monopoly of goods with particularity.Fake and shoddy products will cause losses to the national economy, affect the health of consumers, and make consumers doubt the monopoly of the state and the monopoly system; chapter II, the destruction and infringement of exclusive rights of counterfeit and shoddy products to the exclusive rights of trademarks of commodities,The third chapter is about the liability of the infringement of fake and inferior products, including the system of proof of trademark infringement, the distribution of burden of proof and the infringement of franchise, and the analysis of burden of proof of trademark right of monopoly.The fourth chapter deals with the construction of measures for enterprises to deal with the infringement of counterfeit and shoddy goods, including the trademark protection measures of Chinese enterprises in various stages and the trademark protection experience of developed country enterprises such as the United States.
