【摘要】：伴隨現(xiàn)代體育運動的蓬勃發(fā)展,業(yè)余體育運動中的暴力侵權也愈演愈烈,因此類侵權本身有別與一般侵權的特殊性,本文從其特征入手,深入探討業(yè)余體育運動中暴力侵權的諸多法律問題及成因,并給出相應的解決辦法。業(yè)余體育運動中的暴力侵權具有五大特征,即侵權者主觀意圖難以判定、侵權行為具有強力性和應受規(guī)則約束性、侵權結(jié)果多為嚴重的人身損害、行為主體多為非專業(yè)的運動參加者、侵權責任承擔者多樣化,這五大特征使業(yè)余體育運動中的暴力侵權區(qū)別于一般的侵權,從而具有研究的價值和意義。歸責原則的適用不當、自甘風險抗辯事由的適用存在缺陷、責任主體的認定存在爭議,成為業(yè)余體育運動暴力侵權司法實踐中最主要的三大法律問題。本文通過分析這三大法律問題的成因,進而提出完善侵權責任的判定,合理界定責任承擔主體的建議,并以體育保險制度來彌補此類侵權中損害賠償?shù)牟蛔恪?br/>[Abstract]:Along with the vigorous development of modern sports, the violent infringement in amateur sports is becoming more and more serious. Because this kind of tort itself is different from the particularity of general tort, this article starts with its characteristics.This paper probes into many legal problems and causes of violence infringement in amateur sports, and gives corresponding solutions.There are five characteristics of violence infringement in amateur sports, that is, the tortfeasor's subjective intention is difficult to judge, the tortious act is strong and should be bound by rules, and the result of infringement is mostly serious personal injury.The behavior subjects are mostly non-professional sports participants, and the liability bearers of tort are diversified. These five characteristics make the violence tort in amateur sports different from the general tort, so it has the value and significance of research.The improper application of the principle of imputation, the defect of the application of the reason of risk defense and the dispute of the subject of responsibility have become the three main legal problems in the judicial practice of amateur sports violence infringement.By analyzing the causes of these three legal problems, this paper puts forward the suggestion of perfecting the judgment of tort liability, reasonably defining the subject of liability, and making up for the deficiency of damages in this kind of tort by sports insurance system.
