【摘要】：專利善意侵權(quán)制度最早是從2000年修法時確立,歷經(jīng)十幾年的司法實踐已被廣大從業(yè)人員所接受。在制度層面上,專利法、專利法實施細則以及最高人民法院關(guān)于審理專利侵權(quán)案件的司法解釋等文件中對其均有規(guī)范,足見其實踐重要性。然而,關(guān)于善意侵權(quán)行為的責(zé)任承擔(dān)問題,理論和實務(wù)界一直存在爭議,無過錯責(zé)任原則和過錯責(zé)任原則的如何適用是主要爭議點。本文對專利善意侵權(quán)的構(gòu)成要件具體剖析,針對該侵權(quán)行為多重責(zé)任承擔(dān)的問題提出了二元歸責(zé)論,以期解決其中復(fù)雜的歸責(zé)問題。
[Abstract]:The system of patent bona fide infringement was first established in 2000 when the law was amended. After more than ten years of judicial practice, it has been accepted by the vast number of practitioners. The detailed rules for the implementation of the Patent Law and the judicial interpretation of the Supreme people's Court concerning the trial of patent infringement cases are all standardized, which shows the practical importance of the patent law. However, on the issue of liability for bona fide infringement, There has always been a dispute in theory and practice, and how to apply the principle of no-fault liability and the principle of fault liability is the main controversial point. This paper puts forward the dualistic imputation theory in order to solve the complex imputation problem.
