【摘要】：植物新品種權作為一種重要的農業(yè)知識產權,在我國的發(fā)展時間較短,制度建設還有待成熟。文章嘗試從育種者權利與農民權益平衡的視角,探討我國植物新品種保護制度存在的問題和完善的對策,從而使植物新品種權與農民權之間的矛盾能夠得到解決,使二者利益達到平衡,并形成互惠互利的良性循環(huán)。
[Abstract]:As an important agricultural intellectual property right, plant new variety right has a short development time in our country, and the system construction needs to be mature. This paper tries to balance the rights of breeders and farmers' rights and interests from the perspective of breeders' rights and farmers' rights and interests. This paper probes into the problems existing in the protection system of new plant varieties in our country and the perfect countermeasures, so that the contradiction between the rights of new plant varieties and the rights of farmers can be solved, the interests of the two can be balanced, and a virtuous circle of mutual benefit and mutual benefit can be formed.
