【摘要】：我國《物權(quán)法》第十四章共14個(gè)條文規(guī)定了地役權(quán)制度,意義重大、深遠(yuǎn),但條文間不無抵牾,且適用范圍僅限于土地的利用關(guān)系,遠(yuǎn)不足以應(yīng)對(duì)實(shí)際的需要。為適應(yīng)社會(huì)的變遷與進(jìn)步,提高土地及其上建構(gòu)物的利用效益,增強(qiáng)海域立體分層的使用價(jià)值,我國實(shí)有必要在民法典編纂之際,修改現(xiàn)行法關(guān)于地役權(quán)的規(guī)定,使其變革和演化為將供、需役客體擴(kuò)張至土地及其上的建構(gòu)物、海域和空間的不動(dòng)產(chǎn)役權(quán)制度。同時(shí),基于現(xiàn)代城市規(guī)劃與城鎮(zhèn)社區(qū)開發(fā)過程中良好風(fēng)貌和格局之形成的需要、土地利用已從平面向空間發(fā)展的現(xiàn)狀以及合理限制營業(yè)競(jìng)爭(zhēng)方式的多元化趨勢(shì),我國應(yīng)考慮創(chuàng)設(shè)不動(dòng)產(chǎn)役權(quán)的特殊次類型,即自己不動(dòng)產(chǎn)役權(quán)、空間役權(quán)和營業(yè)禁止役權(quán),以完善現(xiàn)行法上的役權(quán)制度,實(shí)
[Abstract]:There are 14 articles in Chapter 14th of the Real right Law of our country, which provide the easement system, which is of great significance and far-reaching. However, there are not no conflicts between the articles, and the scope of application is limited to the relationship of land use. In order to adapt to the changes and progress of society, to improve the utilization benefit of land and its structures, and to enhance the use value of three-dimensional stratification of sea area, it is necessary for our country to codify the Civil Code. To amend the provisions of the current law on easements so that they change and evolve into systems of real estate servitude that will be supplied, the object of servitude will extend to the land and its constructors, sea areas and space. At the same time, Based on the needs of the formation of good features and patterns in the process of modern urban planning and urban community development, the present situation of land use has developed from plane to space and the diversified trend of reasonable restriction of business competition mode has been pointed out. In order to perfect the system of servitude in current law, our country should consider the creation of special subtypes of real estate servitude, namely, the right of real estate servitude, the right of space servitude and the right to prohibit service in business.
