【摘要】：在機票銷售代理訴訟實踐中,常見的銷售代理合同糾紛主要涉及合同關(guān)系、合同性質(zhì)、合同效力和退改簽費用等爭議類型,不同糾紛的司法認定不同。合同傳真件不能單獨證明機票銷售代理合同關(guān)系的成立,沒有雙方簽字蓋章的代理協(xié)議書,可根據(jù)雙方行為、合同履行情況或其他證據(jù)確認機票銷售代理關(guān)系的存在。機票銷售代理合同在性質(zhì)上應(yīng)是一種服務(wù)合同而非買賣合同,銷售代理資質(zhì)被注銷應(yīng)導致代理合同無效而非合同解除,違反管理性強制規(guī)定的機票銷售代理合同不能被認定為無效。退改簽費用征收比例的規(guī)定對機票銷售代理人同樣有拘束力,超額收取退票費構(gòu)成違約,應(yīng)予以退回。
[Abstract]:In the practice of air ticket sales agency litigation, the common disputes of sales agency contract mainly involve the contract relationship, the nature of the contract, the validity of the contract and the cost of resigning the contract. The judicial cognizance of different disputes is different. The fax copy of the contract cannot independently prove the establishment of the contractual relationship of air ticket sales agency. Without the agency agreement signed and sealed by both parties, the contract may be based on the acts of both parties, The performance of the contract or other evidence confirms the existence of the air ticket sales agency relationship. The air ticket sales agency contract shall in nature be a service contract rather than a sale contract, and the cancellation of the qualification of the sales agent shall result in the cancellation of the agency contract rather than the termination of the contract, The air ticket sales agency contract that violates the management compulsory stipulation cannot be regarded as invalid. The stipulation that the resigning fee levy proportion has the same binding force to the ticket sales agent, the overcharge of refund fee constitutes a breach of contract, should be returned.
