【摘要】：本文在收集大量資料和民間調(diào)查的基礎(chǔ)上,從多角度分析了我國現(xiàn)行《繼承法》法定繼承人范圍和順序的相關(guān)立法規(guī)定,并提出了自己的想法和見解。其中將法定繼承人范圍作了適當擴大,在法定繼承人順序方面做較大調(diào)整,并歸納總結(jié)出確定法定繼承范圍和順序的三項原則:一是在法定繼承的每個順序中,只確定一個繼承人主體;二是確定法定繼承人范圍問題上,改變過去只采用親等的方法,采取親等和親系相結(jié)合的方法;三是在確定法定繼承人順序時,首先遵循自然法則,使卑親屬優(yōu)先繼承,尊親屬和旁系親屬靠后排列。本文共分五個部分。第一部分緒論共敘述三個問題,首先是論述了繼承法法定繼承范圍和順序的概念和主要內(nèi)容,其次論述了法定繼承人范圍和順序立法的研究動態(tài),再次是本文研究法定繼承范圍和順序的創(chuàng)新點。第二部分論述了決定法定繼承人范圍和順序的影響因素和依據(jù)。首先,影響確定法定繼承范圍和順序的因素有兩個:一是當時的生產(chǎn)方式水平,另一個是該民族的傳統(tǒng)文化和習俗。本文通過人類歷史的發(fā)展歷程,對民族繼承到宗族繼承,宗族繼承再到家庭繼承進行了闡述。其次對確定法定繼承人范圍的依據(jù)進行了論述,其中包括婚姻關(guān)系、血緣關(guān)系和扶養(yǎng)關(guān)系,但在世界各國繼承法中,只有少數(shù)國家采用上述所有三個因素作為確定法定繼承人范圍的依據(jù),其中包括我國現(xiàn)行《繼承法》,而多數(shù)國家只采用上述的前兩個因素。第三部分中,首先簡述我國法定繼承范圍和順序的歷史演變過程;其次對1985年我國《繼承法》法定繼承范圍和順序進行了分析;再次對我國《繼承法》的司法情況進行闡述和分析;最后提出了我國現(xiàn)行《繼承法》法定繼承人范圍和順序存在的主要問題。第四部分是對域外國家和地區(qū)法定繼承范圍和順序進行了考察,其中包括俄羅斯、日本、英國、美國、韓國以及我國臺灣地區(qū)。第五部分是本文的重點,是本文對完善我國法定繼承制度立法的建議。提出了確定法定繼承人范圍和順序的三點原則性建議和確定法定繼承人范圍和順序的具體方案。
[Abstract]:On the basis of collecting a large amount of data and folk investigation, this paper analyzes the relevant legislative provisions of the scope and order of the legal heirs in the present succession Law in China from various angles. And put forward his own ideas and opinions. Among them, the scope of the statutory heirs has been appropriately expanded, and the order of the legal heirs has been greatly adjusted. And summed up three principles for determining the scope and order of legal succession: first, in each order of legal succession, only one successor subject is determined; second, in determining the scope of legal succession, we should change the past method of using only parents. Third, when determining the order of legal heirs, we should first follow the law of nature, so that inferior relatives take precedence over inheritance. This paper is divided into five parts. The first part is an introduction to three problems. Firstly, it discusses the concept and main content of the scope and order of inheritance law. Secondly, it discusses the research trends of the scope and order legislation of statutory heirs, which is the innovation point of this paper in studying the scope and order of legal succession. The second part discusses the influencing factors and the basis of determining the scope and order of statutory heirs. There are two factors influencing the determination of the scope and order of legal inheritance: one is the level of production mode at that time, the other is the traditional culture and customs of the nationality. Secondly, it discusses the basis of determining the scope of legal heirs, including marital relations, blood relations and maintenance relations, but in the inheritance laws of various countries in the world, Only a small number of States use all three of these factors as the basis for determining the scope of the statutory successor, including our current succession Law, while most States use only the first two of these factors... in part III, Firstly, the historical evolution process of the scope and order of legal succession in China is briefly described; secondly, the scope and order of legal succession in 1985 are analyzed, and then the judicial situation of succession Law in China is expounded and analyzed. Finally, the author points out the main problems in the scope and order of legal succession in China's current succession Law. Part 4th examines the scope and order of legal succession of foreign countries and regions, including Russia, Japan, Britain, the United States, Part 5th of Korea and Taiwan is the focus of this paper. It is a suggestion to perfect the legislation of legal succession system in our country. The author puts forward three suggestions of principle to determine the scope and order of legal heirs and a concrete scheme to determine the scope and order of legal heirs.
