【摘要】：警察執(zhí)法權(quán)與公民隱私權(quán)作為一對矛盾共同體,其統(tǒng)一的一面表現(xiàn)為警察執(zhí)法權(quán)是保障包括隱私權(quán)在內(nèi)的個體公民人權(quán)的必要手段,警察執(zhí)法權(quán)服從于保障人權(quán)的最終目的;其對立的一面表現(xiàn)為在特定情形下警察執(zhí)法權(quán)要優(yōu)先于公民隱私權(quán)以及現(xiàn)實生活中警察執(zhí)法權(quán)對公民隱私權(quán)各種形式的侵害。協(xié)調(diào)兩者之間對立沖突的方法是通過法律設(shè)定警察執(zhí)法權(quán)干預(yù)公民隱私權(quán)的實體和程序條件,并規(guī)定警察執(zhí)法權(quán)侵害公民隱私權(quán)的補救措施。
[Abstract]:The police law enforcement right and the citizen ' s right of privacy act as a pair of contradictory communities . The unified aspect shows that the police law enforcement right is the necessary means to guarantee the human rights of individual citizens , including the right of privacy , and the police law enforcement right is subordinate to the ultimate aim of guaranteeing human rights . The opposite side expresses that the police law enforcement right in a certain situation takes precedence over the citizen ' s right to privacy and the police law enforcement right in the real life . The method of coordinating the conflict between the two is to set police law enforcement right to interfere with the entity and procedure condition of citizen ' s right to privacy and stipulate the remedy of the police law enforcement right against the privacy of citizens .
