【摘要】：本文以民法的發(fā)展歷程為時(shí)間線索,以人們?cè)诿袷铝⒎ê蛯?shí)踐活動(dòng)中對(duì)于個(gè)體價(jià)值取向、群體價(jià)值取向的選擇為理論線索,展開敘述。在對(duì)個(gè)體價(jià)值取向、群體價(jià)值取向、兩者之間關(guān)系進(jìn)行法哲學(xué)視域下的理論分析的基礎(chǔ)上,通過歷史的回顧,研究不同歷史條件下,民法價(jià)值取向選擇的現(xiàn)實(shí)依據(jù)。最后對(duì)當(dāng)代民法價(jià)值取向的轉(zhuǎn)換進(jìn)行探討。當(dāng)代民法的價(jià)值取向不應(yīng)該局限在個(gè)體與群體之間的選擇,而應(yīng)該歸回人本身,突出對(duì)于人的保護(hù)、對(duì)于弱者的保護(hù)。本文將民法價(jià)值取向的選擇范圍設(shè)定為個(gè)人與國(guó)家、個(gè)人與社會(huì)團(tuán)體、個(gè)人與個(gè)人之間,而不是簡(jiǎn)單地以個(gè)人價(jià)值取向、社會(huì)價(jià)值取向來表達(dá)民法的本位。
[Abstract]:This article takes the development course of civil law as the time clue, takes the choice of individual value orientation and group value orientation in civil legislation and practice activities as the theoretical clue, unfolds the narration. On the basis of the theoretical analysis of the orientation of group value and the relationship between them from the perspective of philosophy of law, through the review of history, this paper studies the different historical conditions. Finally, the conversion of value orientation of contemporary civil law is discussed. The value orientation of contemporary civil law should not be limited to the choice between individuals and groups, but should be returned to the person himself. Focusing on the protection of the human, the protection of the weak. This article sets the choice range of the value orientation of the civil law as individual and country, individual and social group, individual and individual, but not simply individual value orientation. Social value orientation to express the standard of civil law.
