【摘要】：在商標(biāo)使用管理與授權(quán)確權(quán)實(shí)踐中,我國(guó)商標(biāo)法均有關(guān)于商標(biāo)改變的規(guī)定,因而注冊(cè)商標(biāo)同一性規(guī)范有管理規(guī)范與確權(quán)規(guī)范兩類(lèi)。在商標(biāo)權(quán)維持中,根據(jù)管理規(guī)范與確權(quán)規(guī)范分別作出的結(jié)論可能會(huì)存在沖突。在管理規(guī)范單獨(dú)適用的領(lǐng)域內(nèi),不當(dāng)適用會(huì)妨礙私權(quán)保護(hù)。結(jié)合其他法域立法經(jīng)驗(yàn)與合理性分析,管理規(guī)范可以融入現(xiàn)有體系,確權(quán)規(guī)范以保護(hù)商標(biāo)權(quán)人積累起來(lái)的商譽(yù)為價(jià)值目標(biāo),應(yīng)當(dāng)作為商標(biāo)形式的判斷準(zhǔn)則。因此,建議刪除管理規(guī)范,并規(guī)定注冊(cè)商標(biāo)同一性規(guī)范可以適用于與商標(biāo)使用有關(guān)的所有領(lǐng)域。
[Abstract]:In the practice of trademark use management and authorization, trademark law of our country has provisions on trademark change, so there are two kinds of norms of trademark identity. There may be conflicts between the conclusions drawn according to the management norms and the confirmed rights norms. In the field where the management norms are applied separately, the improper application will hinder the protection of private rights. Combined with the legislative experience and rationality analysis of other jurisdictions. Management norms can be integrated into the existing system. The norm of confirming rights aims at protecting the goodwill accumulated by the trademark owner and should be taken as the judgment criterion of trademark form. Therefore, it is suggested to delete the management norm. It also stipulates that the trademark identity criterion may be applied to all areas related to the use of the trademark.
