【摘要】：地理標志權(quán)作為與農(nóng)業(yè)發(fā)展息息相關(guān)的知識產(chǎn)權(quán)類型,對于我國這樣的農(nóng)業(yè)大國來說,它的重要性是不言而喻的,正因為如此,農(nóng)產(chǎn)品地理標志的保護也越發(fā)受到各級政府的重視。陜西省擁有大量的農(nóng)產(chǎn)品地理標志資源,其主要集中在水果、茶葉、花椒以及中藥材方面。為了大力發(fā)展陜西省的農(nóng)業(yè)經(jīng)濟,促使陜西省農(nóng)產(chǎn)品走上更廣闊的市場領(lǐng)域,保護農(nóng)產(chǎn)品地理標志就成為最有效的手段之一。然而,由于我國對地理標志保護的起步時間較晚,迄今為止仍存在很多的立法沖突和制度缺陷,這無疑在很大程度上阻礙了地理標志產(chǎn)品的發(fā)展。加之,陜西省地處我國西部,公眾對于知識產(chǎn)權(quán)的保護意識相對較弱,因此便造成了政府部門一方在大力推動地理標志產(chǎn)品的注冊,但企業(yè)一方卻不愿意申請使用相應(yīng)地理標志的尷尬局面,更有部分生產(chǎn)經(jīng)營者投機取巧,假冒、偽造地理標志產(chǎn)品并以超高價銷售,久而久之,便失去了消費者對地理標志產(chǎn)品的信賴。故而,為了更好更高效的保護和發(fā)展陜西省農(nóng)產(chǎn)品地理標志,就需要從陜西省的實際情況出發(fā),制定合理的發(fā)展目標和規(guī)劃,對發(fā)展中遇到的問題和困難進行拆解和分析,在借鑒國內(nèi)外關(guān)于地理標志保護先進經(jīng)驗的基礎(chǔ)上,具體包括法律規(guī)定、制度設(shè)計、監(jiān)管體系及其他措施等各個方面,促使陜西省地理標志產(chǎn)品的發(fā)展展開新局面、邁上新臺階。
[Abstract]:As a type of intellectual property which is closely related to the development of agriculture, the right of geographical indication is of great importance to a large agricultural country such as China, which is precisely because of this. The protection of geographical indications of agricultural products has been paid more and more attention by the governments at all levels. Shaanxi Province has a large number of geographical indications of agricultural resources, mainly concentrated in fruit, tea. In order to develop the agricultural economy of Shaanxi Province and promote the agricultural products of Shaanxi Province to enter the broader market field, the protection of geographical indications of agricultural products has become one of the most effective means. Due to the late start of the protection of geographical indications in our country, there are still many legislative conflicts and system defects so far, which undoubtedly hinders the development of geographical indication products to a great extent. Shaanxi Province is located in the west of China, the public awareness of intellectual property protection is relatively weak, so the government department is vigorously promoting the registration of geographical indication products. However, the enterprise side is unwilling to apply for the awkward situation of using the corresponding geographical indications, and some of the producers and operators are more opportunistic, counterfeit, counterfeit and sold at high prices. Therefore, in order to better and more efficient protection and development of geographical indications of agricultural products in Shaanxi Province, we need to proceed from the actual situation of Shaanxi Province. To formulate reasonable development goals and plans, to disassemble and analyze the problems and difficulties encountered in the development, on the basis of drawing lessons from the advanced experience in the protection of geographical indications at home and abroad, including the specific legal provisions and system design. Supervision system and other measures promote the development of geographical indication products in Shaanxi Province to a new stage.
