【摘要】：隨著人們物質(zhì)生活水平的提高，人們對健康的要求也越來越高。對藥物的需求變得愈來愈普遍，藥物專利制度在保護藥物生產(chǎn)者的利益之時，在一定程度上也阻礙著人們對健康藥物多樣性要求。因此，許多國家在探索建立藥物專利強制許可制度來平衡大眾對藥物基本需求與生產(chǎn)者利益獲得。在我國，改革開放后，包括藥物專利制度在內(nèi)的諸多專利制度才逐步建立起來，在向其他國家學習借鑒過程中，我國也在探索本國的藥物專利強制許可制度。 藥物專利強制許可的目的是為了維護公共健康，政府中相關(guān)專利管理部門對已經(jīng)取得專利權(quán)的藥物轉(zhuǎn)移給非專利權(quán)人授權(quán)進行制造、并支付相對較低補償費用的強制許可。藥物專利強制許可的主體制度、許可范圍制度、強制許可條件等實體制度是其中重要內(nèi)容，當然在法律中還包括強制許可的基本條件等程序制度。要解決藥物專利壟斷利益和社會公共健康沖突，藥物強制許可制度無疑是最佳選擇之一。我國藥物專利強制許可還沒有完全實踐，僅在理論層面就面臨著一些問題，比如在對申請藥物強制許可內(nèi)容到底如何界定，對何種情況下、由誰負責申請、申請藥物專利強制許可各種條件表述和規(guī)定還不明確、藥物專利的強制許可程序并沒有獨立出來等等。借鑒他國經(jīng)驗，，結(jié)合我國藥物強制許可的條件，筆者以為應從以下幾個方面進行完善：對申請主體的條件進行簡化；對強制許可程序本著效率原則進行簡化；健全對專利權(quán)利人的權(quán)益保障措施；對于藥物強制許可使用費的計算方法進行原則性描述。
[Abstract]:With the improvement of people's material standard of living, the demand for drugs becomes more and more common, and the patent system of drugs is protecting the interests of drug producers. Therefore, many countries are exploring the establishment of drug patent licensing system to balance the basic needs of the public and the interests of producers. After the reform and opening up, many patent systems, including drug patent system, have been gradually established. In the process of learning from other countries, our country is also exploring the compulsory licensing system of drug patents. The purpose of compulsory licensing of drug patents is to maintain public health, the relevant patent authorities in the government transfer of patented drugs to the non-patentee authorized to manufacture. And pay relatively low compensation fees for compulsory licensing. Drug patent compulsory licensing of the main system, licensing scope system, compulsory licensing conditions and other substantive systems are the important content. Of course, in the law also includes the basic conditions of compulsory licensing and other procedural systems. To solve the monopoly interests of drug patents and social public health conflicts. Compulsory drug licensing system is undoubtedly one of the best options. Compulsory licensing of drug patents in China has not been fully implemented, only in the theoretical level is facing some problems. For example, in the application for the content of compulsory drug licensing in the end how to define, under what circumstances, who is responsible for the application, the application for drug patent compulsory licensing conditions and provisions are not clear. Drug patent compulsory licensing procedures are not independent and so on. Learn from the experience of other countries, combined with the conditions of compulsory licensing of drugs in China. The author thinks that should be perfected from the following aspects: simplify the conditions of the main body of the application; Simplification of compulsory licensing procedures based on the principle of efficiency; To improve the protection measures for the rights and interests of patent holders; The calculation method of drug compulsory license fee is described in principle.
