【摘要】："不良影響"條款規(guī)定在我國《商標(biāo)法》第10條第1款第8項(xiàng),是商標(biāo)標(biāo)識(shí)"禁止使用"情形的兜底,所保護(hù)的法益是公眾利益。由于"不良影響"的內(nèi)涵外延不明確,對(duì)其調(diào)整范圍、保護(hù)法益的認(rèn)識(shí)存在不足,以及法律制度的缺位,導(dǎo)致"不良影響"條款法律適用上的越位和錯(cuò)位。"不良影響"條款是禁止商標(biāo)注冊(cè)和使用的絕對(duì)理由,判斷"不良影響"需結(jié)合多種因素,"造成公眾誤導(dǎo)"的案件并非一律適用"不良影響"條款,當(dāng)僅侵犯公眾利益不涉及特定主體利益時(shí)才可適用。
[Abstract]:"Adverse effects" provisions in China's "trademark law" Tenth article first paragraph eighth, prohibit the use of trademarks is to reveal all the details ", which is the protection of the legal interests of public interest. Due to the unclear connotation and extension of "bad influence", there is a lack of understanding of its scope of adjustment and protection of legal interests, as well as the absence of legal system, leading to offside and dislocation in the application of "adverse effects" clause. The clause of "adverse effects" is the absolute reason for prohibiting the registration and use of trademarks. Judging the adverse effects should be combined with many factors. The case of "public misleading" is not applicable to the "adverse effects" clause. It can be applied only when it infringes public interest and does not involve the interests of a specific subject.
