隨著國際交流活動日趨頻繁,法律翻譯逐漸成為跨地區(qū)和跨文化研究的重點。立法文本,作為一種特殊的法律文本,其詞匯、句法和篇章早已成為學者們所關注的重要問題。不難發(fā)現(xiàn),在中英文立法文本中,條件句均有著非常高的使用頻率。較之于其他文本中的條件句,立法文本中的條件句式往往冗長且復雜。此外,由于中英文兩種截然不同的語法規(guī)則,條件句在立法文本中也有著截然不同的表現(xiàn)方法。鑒于此,筆者收集整理了大約50萬字(詞)的現(xiàn)行中英文立法文本,建立了中英文本的平行語料庫,并提取了4,498個中英文條件句和7個常用的英文條件句從屬連詞。通過對中英文語料進行對比分析,本文作者發(fā)現(xiàn):在本語料庫的所有中英文句子中,共有4,498個條件句,占全部句子的40%;在提取的所有英文條件句中,由“if”引導的條件句占56%;所有的英文條件句都由顯性從屬連詞所引導,然而在其對應的中文條件句中,僅有25%的條件句是由顯性的中文從屬連詞所引導的,余下75%均由隱性詞語所引導;為了強調(diào)“條件”,中英文從句都傾向于“左移結構”。根據(jù)上訴總結概括的英漢立法文本中條件句的異同,在英漢法律條件句的互譯過程中,譯者需要區(qū)分兩種法律條件句的固有表達方...
