如今,公共生活的各個領(lǐng)域,包括文化,娛樂,商業(yè)和學(xué)術(shù)研究在內(nèi)的各個不同的行業(yè),都因為新技術(shù)的出現(xiàn)而產(chǎn)生了徹底的變革。信息科技的發(fā)展更是成為了全球共同關(guān)注的論題。信息與數(shù)據(jù)時代的到來,顯著促進(jìn)了商業(yè),教育,醫(yī)療,政治等社會方面的改善與進(jìn)步。然而,伴隨著信息化社會的急速發(fā)展以及網(wǎng)絡(luò)空間的迅速膨脹,新的問題也隨之涌現(xiàn)。盡管數(shù)字化時代所具有的優(yōu)勢無可非議,其派生的問題同時也不容忽視,其中的網(wǎng)絡(luò)安全問題便正為立法者及專家密切關(guān)注。同時,網(wǎng)絡(luò)安全問題的頻繁發(fā)生、復(fù)雜性和影響也使問題本身更加嚴(yán)峻,尤其是在諸如越南這樣的發(fā)展中國家之中。同其他國家相似,越南的網(wǎng)絡(luò)發(fā)展也極為迅速。因此,越南政府正著手探索法律手段以保護(hù)網(wǎng)絡(luò)安全。本文包括四個主要部分論文的第一部分簡要介紹了網(wǎng)絡(luò)空間的本質(zhì),同時論述了網(wǎng)絡(luò)安全的必要性,以便了解網(wǎng)絡(luò)空間中的潛在危險。此外,網(wǎng)絡(luò)犯罪中的犯罪分子構(gòu)成的危險與傳統(tǒng)犯罪所能帶來的危害極為不同。因此,第二部分旨在介紹網(wǎng)絡(luò)犯罪的法律問題。根據(jù)犯罪目的的不同將各種網(wǎng)絡(luò)犯罪分成易于管理的類別促進(jìn)了國內(nèi)法和國際法的發(fā)展,使得其可以通過判斷犯罪行為歸屬的類別,行使統(tǒng)一化的法律手段來規(guī)定個人或者國家...
