隨著中國經(jīng)濟(jì)迅速發(fā)展,跨境交往日益頻繁。為了穩(wěn)定社會秩序,降低不斷增加的涉外犯罪率,面向外國人特別是外國商人普及中國的法律法規(guī)也顯得日益重要�，F(xiàn)實(shí)中,長久以來受西方法治思維影響的外國人對中國的法律還不甚了解,因?yàn)樵谥袊?諸多法律法規(guī)要么缺乏對應(yīng)的英文,要么缺乏統(tǒng)一準(zhǔn)確的英文譯本。實(shí)踐中甚至有很多外國人反應(yīng)在中國合法權(quán)益受到侵害時(shí),不清楚向哪個(gè)部門尋求法律幫助來維權(quán)。立法是依法治國的第一步,當(dāng)中國正在如火如荼的修改各種法律法規(guī)以更好地服務(wù)經(jīng)濟(jì)和社會發(fā)展全局的時(shí)候,立法文件相應(yīng)的英文譯本建設(shè)卻滯后了。伴隨著中國進(jìn)一步融入國際社會,中國法律法規(guī)翻譯的建設(shè)應(yīng)當(dāng)提上日程。本研究選取了于2012年全國人大修訂的《中華人民共和國刑事訴訟法》(以下簡稱“《刑訴》”)為研究對象,該部法律屬于程序法,詳細(xì)地闡明了有關(guān)刑事犯罪從立案,偵查到審判執(zhí)行等一系列司法程序的環(huán)節(jié)。目前這一立法文件還未有官方統(tǒng)一的英文譯本。本研究從系統(tǒng)功能語言學(xué)元語言功能理論出發(fā),發(fā)現(xiàn)《刑訴》英譯文中元功能意義參數(shù)偏移這一現(xiàn)象,期望可以擴(kuò)大以往的翻譯轉(zhuǎn)移研究,在基于這些偏移是否實(shí)現(xiàn)了中國立法文本翻譯交際目的的基礎(chǔ)上對這些偏移做出是正面...
